REGULATIONS UNDER THE DEFENCE ACT 1903-1975.*

Amendments Of the Military Financial Regulations  

Amendments declared to be relevant amendments for the purposes of regulation 17 of the Defence Force (Reserves) (Financial) Regulations.

1. The amendments effected by these Regulations are declared to be the relevant amendments of the Military Financial Regulations for the purposes of regulation 17 of the Defence Force (Reserves) (Financial) Regulations.

Conditions applicable to rates of salary.

2. Regulation 12h of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (1) the words and figures “ 12 to 12g (inclusive) of these Regulations ” and substituting the words and figures “ 12aa to 12f (inclusive) and for the purposes of the Defence Force (Salaries) Regulations ”;

(b) by inserting before paragraph (c) of sub-regulation (1) the following paragraph:—

“ (a) a member’s period of service in a rank does not include any period for which he is on leave of absence without pay; and ”;

(c) by omitting from paragraph (c) of sub-regulation (1) the word “ length ” and substituting the word “ period ”;

(d) by omitting from paragraph (c) of sub-regulation (1) all words from and including “ for the purpose ”; and

(e) by omitting from sub-regulation (5) the words “ purpose of determining the member’s rate of pay upon appointment and his incremental advancement ” and substituting the words “ purposes of regulations 12aa to 12f (inclusive) and of the Defence Force (Salaries) Regulations ”.

Calculation of salary.

3. Regulation 15 of the Military Financial Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (6) the word “ or ” (last occurring); and

(b) by adding at the end of sub-regulation (6) the following word and paragraph:—

“ or (c) in the case of a member of the Regular Army Reserve, the Regular Army Emergency Reserve or the Citizen Military Forces, who is rendering continuous full-time service—the day on which he ceases to render that service. ”.

4. After regulation 17b of the Military Financial Regulations, the following regulation is inserted:—

Application, of regulations 17A and 17B to certain members.

“ 17ba. In the application of regulations 17a and 17b to and in relation to a member of the Regular Army Reserve, the Regular Army Emergency Reserve or the Citizen Military Forces, being a member who is rendering continuous full-time service, a reference to the termination of the set-vices of a member shall be read as a reference to the member ceasing to render continuous full-time service. ”.

Payment of fees for courses of study.

5. Regulation 171 of the Military Financial Regulations is amended—

(a) by omitting from sub-regulation (3) the words “ active pay and allowances payable to him under these Regulations ” and substituting the words “ salary and allowances payable to him ”;

(b) by omitting from sub-regulation (4) the word “ pay ” and substituting the word “ salary ”; and

(c) by omitting from sub-regulation (4) the words “ under these Regulations ” and substituting the words “ in respect, of his service ”.

Post-graduate and refresher courses—Medical. Officers.

6. Regulation 172 of the Military Financial Regulations is amended by omitting from sub-regulation. (4) the words “ pay and allowances that are or become payable to him under these Regulations ” and substituting the words “ salary and allowances that are or become payable to him in respect of his service ”.

Efficiency grant.

7.(1) Regulation 199 of the Military Financial Regulations is repealed.

(2) Where an efficiency grant would be payable to a member, being a member who was a member immediately before the commencement of this sub-regulation, on completion by him of a particular year’s efficient service if regulation 199 of the Military Financial Regulations had not been repealed by sub-regulation (1), an amount equal to the amount of the efficiency grant that would have been payable to him if that repeal had not been effected is, subject to sub-regulation (3), payable to the member on completion by him of that service.

(3) Where an amount is payable to a member under sub-regulation (2) on completion by him of a year’s efficient service, no amount is payable to the member under that sub-regulation on completion by him of a subsequent year’s efficient service.

(4) In sub-regulations (2) and (3)—

“ member ” means a member of the Citizen Military Forces other than—

(a) an officer; or

(b) a member rendering continuous full-time service;

“ year’s efficient service ” means a year’s service that would, but for the repeal effected by sub-regulation (1), be a year’s efficient service for the purposes of regulation 199 of the Military Financial Regulations as in force immediately before the commencement of this sub-regulation.

8. Regulation 205 of the Military Financial Regulations is repealed and the following regulation substituted:—

Diving Allowance.

“ 205. (1) In this regulation, ‘diver’ has the same meaning as in regulation 17 of the Defence Force (Salaries) Regulations.

“ (2) Subject to sub-regulations (3) and (4), an allowance, called ‘diving allowance’, is payable to a diver in respect of the time during which he is—

(a) under water; or

(b) under compression,

in the course of a diving operation authorized by his commanding officer, at the rate specified, in relation to the greatest depth reached by the diver in the course of the diving operation, in the following table:—

“ (3) For the purpose of sub-regulation (2), all time from the time at which the diver enters the water or goes under compression to the time at which he emerges from the water or ceases to be under compression shall be regarded as time under water at the greatest depth reached by the diver in the course of the diving operation.

“ (4) Subject to sub-regulation (5), where a member who is a diver attends another diver during a diving operation, the member shall not be paid diving allowance but shall be paid an allowance—

(a) equal to one-fifth of the amount of diving allowance payable to the diver attended by the member in respect of that operation, calculated to the nearest cent; or

(b) if the attendant is employed in a compression chamber—calculated at a rate equal to the rate of diving allowance payable to the diver attended by the member in respect of that diving operation.

“ (5) Where a diver attends more than one other diver during a diving operation, diving allowance is payable in accordance with sub-regulation (4) as if he had attended only one other diver during the diving operation. ”.

Officers of Cadets—pay.

9. Regulation 224 of the Military Financial Regulations is amended—

(a) by omitting from, sub-regulation (1) the words and figures “ the table in sub-regulation (1) of regulation 190 of these Regulations ” and substituting the words “ the following table:— ”; and

(b) by adding at the end of sub-regulation (1) the following table:—
