under section 12 of the

(a) by omitting the table in paragraph (b) of sub-regulation (1) and substituting the following table:

(a) by omitting from sub-regulation (1) “Where” (first occurring) and substituting “Subject to sub-regulation (1a), where”; and
(b) by inserting after sub-regulation (1) the following sub-regulation:
“(1a) Where a member to whom sub-regulation (1) applies, is accompanied oversea by a spouse who is employed under the
Public Service Act 1922 and entitled to be paid an allowance in respect of a child under similar conditions as apply to payment of child education allowance under this regulation, the amount of allowance payable under this regulation to the member in respect of that child shall be—(a) in a case where the amount of allowance payable to the spouse is less than the amount of allowance that would be payable to the member but for this sub-regulation—an amount equal to the difference between the amount payable to the spouse and the amount that would be payable to the member but for this sub-regulation; or
(b) in any other case—the amount, if any, assessed by the Minister having regard to—
(i) the amount of the allowance payable to the member’s spouse in respect of that child’s education;
(ii) the amount of the allowance which would, but for this sub-regulation, have been payable to the member in respect of that child under this regulation;
(iii) the school which the child is attending during the member’s posting oversea;
(iv) the type of accommodation provided for the child while attending that school; and
(v) the amount expended by the member or his spouse in respect of the child’s schooling and accommodation.”.
(a) an authorized journey within the meaning of Division 10 of Part II of those Regulations, or part of such an authorized journey, made on or after 1 May 1982; and
(b) travel in respect of which meal allowance is payable under regulation 107 of those Regulations undertaken on or after 1 May 1982.
