REGULATIONS UNDER THE DEFENCE ACT 1903-1934.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1934.

Amendments of the Military Financial Regulations. 

1. Regulation 27 of the Military Financial Regulations is repealed and the following regulation inserted in its stead:—

Variations in cost of living.

“27.—(i) For the purposes of this regulation the term ‘index-number’ means the weighted average retail price index number for the six State Capital cities of the Commonwealth, as shown in the ‘Court’ series of retail price index numbers published from time to time by, or at the direction of, the Commonwealth Court of Conciliation and Arbitration.

(ii) Where the index number for the six months ending on the thirty-first day of March or the thirtieth day of September in any year is less than 79.4, the annual rates of pay payable to members of the Permanent Military Forces in pursuance of regulations 28, 29 and 31 to 42 (both inclusive) of these Regulations shall, as from the commencement of the first pay-period beginning in the month of July or the month of January (as the case may be) next following, be reduced by the appropriate amount shown in the following Table opposite the index number group within which the said index number falls:—

(iii) If the index number falls below 61.0 the annual rates of pay of members of the Permanent Military Forces shall be further reduced on the basis indicated in the last preceding sub-regulation, that is to say, for each fall of 2.3 points in the index number rates of pay shall be reduced by £6 per annum.

(iv) Where the index number for the six months ending on the thirty-first day of March or the thirtieth day of September in any year exceeds 79.3, the annual rates of pay payable to members of the Permanent Military Forces in pursuance of regulations 28, 29 and 31 to 42 (both inclusive) of these Regulations shall, as from the commencement of the first pay-period beginning in the month of July or the month of January (as the case may be) next following, be increased by the appropriate amount shown in the following Table opposite the index number group within which the said index number falls:—

(v) If the index number rises above 97.7 the annual rates of pay of members of the Permanent Military Forces shall be further increased on the basis indicated in the last preceding sub-regulation, that is to say for every rise of 2.3 points in the index number rates of pay shall be increased by £6 per annum.

(vi) The amount of £16 per annum shall be added to the annual rates of pay of each member of the Permanent Military Forces payable in pursuance of regulations 28, 29 and 31 to 42 (both inclusive) of these Regulations alter variation has been made in accordance with the foregoing provisions of this regulation.

(vii) The amount of £16 per annum referred to in sub-regulation (vi) of this regulation shall be deemed for all purposes to be pay.

(viii) The first adjustment of pay of members of the Permanent Military Forces under this regulation shall be made as from the commencement of the first fortnightly pay period beginning in January, 1938, and shall be based on the index number for the six months ended on the thirtieth day of September, 1937, which shall be deemed to be 70.6.”.

Deductions for rations.

2. Regulation 44 of the Military Financial Regulations is amended by omitting the proviso to sub-regulation (i) and inserting in its stead the following proviso:—

“Provided that, where the pay of a member of the Permanent Military Forces is increased or reduced in accordance with the provisions of regulation 27 of these Regulations, the deduction for a cooked ration as prescribed in this regulation shall be increased or decreased, as the case may be, at the rate of one penny per week for each one pound of variation in his annual rate of pay.”.
