STATUTORY RULES.
REGULATIONS UNDER THE DEFENCE ACT 1903-1934.*

under the

Amendments of the Military Financial Regulations.
“Part XIX.—Senior Cadets.
“183. In this Part, unless the contrary intention appears—
‘school detachment’ means a detachment of senior cadets at an educational establishment;
‘regimental detachment’ means a detachment of senior cadets which is affiliated with a militia unit.
“184. A senior cadet officer, who is authorized by a formation, &c, commander to attend camp with a unit of the Militia Forces, may be paid the field allowance prescribed in respect of a militia officer of equal rank and be granted free rations under the conditions applicable to officers of that unit.
“184a. (i) Subject to this regulation and to provision being made by the Parliament, an allowance at the rate of £3 per annum may be paid to each senior cadet officer within the authorized establishment;
Provided that an officer who serves for portion of the year may be paid an allowance of one-twelfth of £3 for each complete month of service rendered.
(ii) An allowance under this regulation shall be paid only on the approval of the formation, &c, commander upon receipt of a certificate by his brigade major that the officer concerned has performed his duties efficiently.

(iii) The allowance shall be payable on 1st February and 1st August of each year in respect of the half-years ending on 31st January and 31st July respectively.
“184b. (i) A senior cadet officer, not being a student at an educational establishment, may be paid on first appointment an outfit allowance not exceeding £6 in respect of the purchase by him of the following articles of a pattern approved by the Military Board:—
Hat or cap.
Jacket.
Breeches or trousers.
Boots with laces.
Leggings or puttees.
(ii) Upon completion of each period of five years’ commissioned service a senior cadet officer, not being a student at an educational establishment, may be paid a further outfit allowance not exceeding £6 in order that he may replace such of the articles, specified in the last preceding sub-regulation, as are certified by his brigade major to be no longer serviceable.
(iii) Upon first appointment to a commission in the Senior Cadets cadet-lieutenant who is a student at an educational establishment may be paid an outfit allowance not exceeding £3 to meet part of the cost of uniform.
“185. (i) Subject to this regulation and to provision being made by the Parliament, allowances at the following rates may be paid annually to each school detachment:—
(
a ) Ten shillings for each senior cadet (including a warrant or non-commissioned officer) on the authorized establishment of the detachment who is classified ‘ efficient’ on the 31st December of the financial year in respect of which the allowance is claimed and is so shown in the annual efficiency return furnished by the detachment; and(
b )Ten shillings for each senior cadet officer and senior cadet (including a warrant or non-commissioned officer) on the authorized establishment of the detachment who attends, for not less than five days, a camp of the detachment which is held during the financial year in respect of which the allowance is claimed:Provided that where a senior cadet’s attendance at camp has been curtailed owing to illness or other substantial cause, not being a disciplinary one, the allowance may be paid on the approval of the formation, &c, commander.
(ii) The allowances payable under this regulation shall be paid to the officer commanding the detachment and, as soon as received by him, shall be paid into a bank account in the name of the detachment. This account shall be kept distinct from any other bank account and shall be operated on by the officer commanding the detachment as Signing Officer, and the headmaster of the educational establishment or a member of the educational establishment staff nominated by the headmaster as Counter-signing Officer.
(iii) The allowances payable under this regulation may be expended only upon the following services:—
(
a ) provision and maintenance of uniforms;(
b ) care and preservation of arms;(
c ) postage and stationery;(
d )payment of the value of losses and damages to government stores for which the detachment is held to be responsible;(
e ) expenses of camps held by the detachment including fares to and from camps; and(
f ) such other services for the benefit of the detachment as a whole as are approved by the Military Board.
(iv) The allowances payable under this regulation shall be accounted for in such manner as is approved by the Military Board.
(v) Upon the disbandment of a school detachment, the persons authorized under sub-regulation (ii) of this regulation to operate on the bank account shall repay to the District Finance Officer any unexpended portion of allowances received by the detachment, and the District Finance Officer shall credit to revenue the sum so repaid.
(vi) At the discretion of the Military Board, the total amount of allowances payable to a school detachment in any financial year may be reduced by any portion of the unexpended balance of allowances paid to that detachment prior to the commencement of that financial year.
“185a. Officers and selected non-commissioned officers of school detachments who are authorized to attend a continuous course of military instruction may be granted—-
(
a ) transport to and from the course of instruction and meal allowance, whilst so travelling, in accordance with regulation 217 of these Regulations; and(
b )tentage or quarters and subsistence whilst attending the course of instruction.
“185b. Personnel of regimental detachments who are selected to attend a continuous course of instruction, or a school or course of instruction which is held in conjunction with or as part of a school or course for officers, warrant or non-commissioned officers of the Militia Forces, may be granted—
(
a )transport to and from the course of instruction or school and meal allowance, whilst so travelling, in accordance with regulation 217 of these Regulations; and(
b ) tentage or quarters and subsistence whilst attending the course or school.”.
“193. (i) Subject to this regulation, a member of the Militia Forces who attends, for not less than ten working days, a school or course of instruction (not being a course of instruction at the Command and Staff School or under section 21aof the Defence Act) shall be paid for each day of his attendance an allowance at the rate of one-half of the Militia pay of his substantive rank.
(ii) Subject to this regulation, an officer of the Militia Forces who attends, for not less than six working days, a course of instruction at the Command and Staff School or under section 21aof the Defence Act, shall be paid for each day of his attendance an allowance at the rate of one-half of the Militia pay of his substantive rank:
Provided that, for the purposes of this sub-regulation, the substantive rank of a formation, &c, commander shall be deemed to be that of colonel.
(iii) Subject to this regulation, a cook of the Militia Forces (or a private soldier of the Militia Forces who is being trained for appointment as a cook) who attends, for not less than ten working days, a course of instruction in cookery, shall be paid for each day of his attendance, in addition to the allowance prescribed in sub-regulation (i) of this regulation, an allowance at the rate of one-half of the special duty pay prescribed in regulation 155 of these Regulations.
(iv) The allowances prescribed in sub-regulations (i) and (iii) of this regulation shall not, unless with the approval of the Military Board, be paid to any member of the Militia Forces for attendance at more than two schools or courses of instruction in any financial year.
(v) An allowance shall not be paid under this regulation to any member whose work is reported upon unfavorably by the chief instructor of the school or course of instruction concerned, or in respect of any day in excess of the total number of working days authorized by the Military Board for the school or course of instruction.
(vi) Notwithstanding anything contained in this regulation, in the case of a member of the Militia Forces who—
(
a ) is evacuated from a school or course of instruction through illness;(
b )is permitted to leave a school or course of instruction for reasons of urgency arising during its progress; or(
c ) is unable to report at the commencement of a school or course of instruction owing to reasons beyond his control,
and is thus prevented from attending for the prescribed number of working days, the Military Board may approve of payment to the member of allowances in accordance with this regulation for the actual number of working days attended:
Provided that—
(
a )in the case of absence through illness, the member produces a medical certificate;(
b )in the case of absence for a cause other than illness specified in this sub-regulation, the member produces documentary evidence as to the cause of his absence; and(
c ) the chief instructor of the school or course reports favorably upon the member’s work.”.
“(iii) Notwithstanding anything contained in this regulation, travelling allowance shall not be paid for journeys to or from a school or course of instruction to any member of the Militia Forces whose work is reported upon unfavorably by the chief instructor of the school or course.”.
