I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903.

Interpretation

1. Regulation 259 of the Military Financial Regulations is amended by omitting the definitions of “dental treatment” and “medical treatment” and substituting the following definitions:

“ ‘dental treatment’ includes the giving of advice, treatment or dental supplies and appliances by or on the authority of a dental officer or dental practitioner;

‘medical treatment’ includes:

(a) the giving of advice, treatment, supplies or appliances by or on the authority of a medical officer or medical practitioner; and

(b) transport in an ambulance; and

(c) maintenance and accommodation at a hospital or other health care facility;

‘member’ means a member rendering continuous full time service;”.

2. Regulation 260 of the Military Financial Regulations is repealed and the following regulation substituted:

Entitlement

“260. (1) The Commonwealth must provide the medical and dental treatment required to keep a member healthy for the purpose of discharging his or her duties.

“(2) The Minister may determine the conditions on which the treatment is to be provided to a member in the light of:

(a) the facilities available under the circumstances (including the place where the member is serving); and

(b) the role of the member; and

(c) the operational requirements of the Defence Force.”.
