An Ordinance to amend the Migratory Birds Ordinance 1980

Short title

1.      This Ordinance may be cited as the Migratory Birds (Amendment) Ordinance 1982.1

Principal Ordinance

2.      In this Ordinance, “Principal Ordinance” means the Migratory Birds Ordinance 1980.2

Permits to take birds

3.      Section 4 of the Principal Ordinance is amended-

(a)   by omitting from sub-section (1) “to him”;

(b)   by omitting from paragraph (2) (a) “purpose of one of the prescribed kinds of purpose specified in paragraphs (5) (a) to (e) inclusive” and substituting “prescribed purpose referred to in sub-section (5)”;

(c)   by omitting from paragraph (2) (b) “purpose of one of the prescribed kinds of purpose specified in paragraphs 5 (a) to (e) inclusive” and substituting “prescribed purpose referred to in sub-section (5)”;

(d)   by omitting from sub-section (5) “kinds of purpose is a prescribed kind of” and substituting “purposes is a prescribed”; and

(e)   by omitting from paragraph (5) (d) “for” (second occurring) and substituting “from”.

Permits for the sale of birds

4.      Section 7 of the Principal Ordinance is amended by omitting from sub-section (1) “to him”.

Permit to sell birds to be issued subject to conditions

5.      Section 8 of the Principal Ordinance is amended by omitting “10” and substituting “9”.

Permits for purchase of birds

6.      Section 10 of the Principal Ordinance is amended-

(a)     by omitting from paragraphs (2) (a) and (b) “purpose of one of the prescribed kinds of purpose specified in paragraphs (5) (a) to (d) inclusive” and substituting “prescribed purpose referred to in sub-section (5)”; and

(b)     by omitting from sub-section (5) “kinds of purpose is a prescribed kind of” and substituting “purposes is a prescribed”.

Inspector may require production of permit, &c.

7.      Section 16 of the Principal Ordinance is amended by omitting from sub-section (3) all the words from and including “Where an inspector” to and including “sub-section (1), he” and substituting “An inspector (other than a member of the police force who is in uniform) who makes a requirement of a person under sub-section (1)”.

Restriction on issue of permit, &c.

8.      Section 18 of the Principal Ordinance is amended by omitting from paragraph (1) (c) “number of”.

Appeal

9.      Section 22 of the Principal Ordinance is amended-

(a)     by omitting from paragraph (1) (b) “cancel or”; and

(b)    by omitting paragraph (1) (c) and substituting the following paragraph:

“(c)   to cancel a permit under paragraph 17 (2) (a),”.

Regulations

10.    Section 25 of the Principal Ordinance is amended by adding at the end thereof the following sub-section:

“(2)   The regulations shall not prescribe a purpose in respect of any provisions of this Ordinance that is not consistent with the Agreement.”.

Additional amendments

11.    The Principal Ordinance is amended as set out in the Schedule.

Schedule 1

12.    Schedule 1 to the Principal Ordinance is repealed and the following Schedule substituted:

The following provisions of the Prinicpal Ordinance are amended by omitting “sub-species” (wherever occurring) and substituting “subspecies”;

Sub-section 3 (1), paragraphs 4 (1) (a) and (b), sub-sections 4 (2), (3) and (4), paragraph 5 (a), paragraphs 7 (1) (a) and (b), sub-section 7 (2), paragraphs 10 (1) (a) and (b), sub-sections 10 (2), (3) and (4), paragraph 11 (a) and paragraph 18 (1) (b).
