Migration (Review) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Migration Act 1958.

1. Commencement

1.1. These Regulations, other than subregulations 4.6 and 9.8 commence on 10 December 1990.

1.2. Subregulations 4.6 and 9.8 are taken to have commenced on 19 December 1989.

2. Amendment

2.1 The Migration (Review) Regulations are amended as set out in these Regulations.

3. Regulation 2 (Interpretation):

3.1 Subregulation 2 (1):

Insert the following definition:

“ ‘equivalent’, in relation to an entry permit, has the same meaning as in the Migration Regulations;”.

3.2 Subregulation 2 (1) (definition of “extended eligibility entry permit”):

Omit the definition.

3.3 Subregulation 2 (2):

Omit the subregulation, substitute:

“(2) In these Regulations, a reference to a particular visa or entry permit is a reference to:

(a) in the case of a visa—a visa of that class as specified in Schedule 2 to the Migration Regulations; and

(b) in the case of an entry permit—an entry permit of that kind as specified in Schedule 3 to those Regulations.”.

4. Regulation 3 (Decisions subject to internal review)

4.1 Subregulation 3 (2):

Omit “or an entry permit of a class”, substitute “specified in the Schedule, the equivalent entry permit or other entry permit”.

4.2 Paragraph 3 (3) (c):

Omit “class”, substitute “kind”.

4.3 Paragraph 3 (4) (b):

Omit the paragraph, substitute:

“(b) the applicant is the holder of a visitor visa or of an equivalent entry permit.”.

4.4 Paragraphs 3 (5) (a) and (b):

Omit “class”, substitute “kind”.

4.5 Subregulation 3 (6):

Omit “or an entry permit of a class”, substitute “specified in the Schedule, the equivalent entry permit or other entry permit”.

4.6 Subregulation 3 (6):

Omit “Schedule is”, substitute “Schedule is, whether or not the application has been lodged,”.

4.7 Paragraph 3 (6) (a):

Omit “entry permits”, substitute “entry permit”.

4.8 Subregulation 3 (7):

Omit the subregulation, substitute:

“(7) A decision by the Minister making an assessment in respect of an applicant for an entry permit or, subject to subregulation (8), a visa, being:

(a) in the case of an entry permit—an entry permit equivalent to a visa of a class specified in the Schedule or other entry permit specified in the Schedule; or

(b) in the case of a visa—a visa of a class specified in the Schedule;

is a relevant decision of the Minister.”.

5. Regulation 5a (Waiver of fee for internal review)

5.1 Omit “has, or will, cause”, substitute “has caused, or will cause,”.

6. Regulation 9 (Review by Tribunal)

6.1 Paragraph 9 (1) (a):

Omit “or an entry permit of a class”, substitute “specified in the Schedule, the equivalent entry permit or other entry permit”.

7. Regulation 12a (Waiver of fee for review by Tribunal)

7.1 Omit “has, or will, cause”, substitute “has caused, or will cause,”.

8. Regulation 20 (Refund of fee for review by Tribunal)

8.1 Paragraph 20 (l) (b):

Omit “regulation 5a”, substitute “regulation 12a”.

9. Regulation 21 (Persons who may apply for review by review authority)

9.1 Paragraph 21 (2) (a):

Omit the paragraph, substitute:

“(a) a person applies, after entry to Australia and being lawfully present in Australia, for the grant of an entry permit, being:

(i) a spouse (after entry) entry permit; or

(ii) a child (after entry) entry permit; or

(iii) an aged parent (after entry) entry permit; and”.

9.2 Paragraph 21 (2) (d):

Omit “relevant class of entry permits”, substitute “entry permit”.

9.3 Paragraph 21 (4) (a):

Omit “entry permits”, substitute “the entry permit”.

9.4 Subregulation 21 (5):

Omit “or an entry permit of a class referred to in Column 2 of an item in the following table:”, substitute “of a class referred to in Column 2 of an item in the following table, or the equivalent entry permit:”.

9.5 Subregulation 21 (5) (heading to table):

Omit:

“Column 2

substitute:

9.6 Subregulation 21 (10):

Omit “or entry permits”, substitute “or the equivalent entry permit”.

9.8 Subregulation 21 (13):

Omit “applicant”, substitute “applicant, or prospective applicant, as the case may be,”.
