Migration (Review) (1993) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Migration Act 1958.

1.   Amendment

1.1   The Migration (Review) (1993) Regulations are amended as set out in these Regulations.

[NOTE:

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.    Regulation 35 (Refund of fee for review by Tribunal)

2.1   Paragraph 35 (2) (b):

Omit “35 (3) (a) or (b),”. substitute “35 (3) (b) or (c).”.

3.    Regulation 39 (Notice of decision of review authority)

3.1   Paragraph 39 (2) (b):

Omit “sent”, substitute “posted”.

4.    New regulation 43a

4.1   After regulation 43, insert:

Directions that may be given in relation to review by a review authority

 “43a. For the purposes of paragraph 118 (4) (ba) of the Act:

  • (a)

    an application for a visa or an entry permit is a prescribed matter; and

  • (b)

    a permissible direction is that the applicant has satisfied a specified criterion for the visa or entry permit.”.
