Migration Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Migration Act 1958.

1. Commencement

1.1 Subject to subregulation 1.2, these Regulations (other than subregulation 5.2) are taken to have commenced on 12 July 1990.

1.2 Regulation 6 is taken to have commenced on 19 December 1989.

2. Amendments

The Migration Regulations are amended as set out in these Regulations.

3. Regulation 2 (Interpretation)

3.1 Subregulation (2):

Omit “any of items 1 to 9 (inclusive)”, substitute “any of the items”.

4. Regulation 18 (Mandatory conditions for grant of visas)

4.1 Subregulation (2):

Omit “Schedule 3”, substitute “Schedule 2”.

5. Regulation 24 (Grant of entry permit)

5.1 Paragraph (2) (a):

Omit subparagraph (vi) (second occurring), substitute:

“(vii) items 30 and 31 in that Part;”.

5.2 Subparagraph (2) (b) (iv):

Omit “9 and 11”, substitute “9, 11 and 12”.

6. Regulation 125 (Prescribed criteria for grant of temporary entry permit to lawful temporary resident or holder of prescribed temporary entry permit)

6.1 Paragraph (c):

Omit “item 10”, substitute “item 9”.

7. Regulation 185 (Fee on application for temporary entry permit granted only in Australia)

7.1 Paragraph (7) (a):

After “subparagraph 125 (d) (ii)”, insert “or regulation 125a”.

8. Schedule 2 (Classes of visas, prescribed criteria and code numbers)

8.1 Part 3, item 12:

Omit “B”.

9. Schedule 4 (Prescribed qualifications and number of points)

9.1 Part 1, item 5:

Omit “paragraph 146 (d)”, substitute “paragraph 146 (e)”.

10. Schedule 8 (Fees)

10.1 Part 1, item 74:

Omit “B”.

10.2 Part 2, item 10:

Omit “B”.
