Migration Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Migration Act 1958.

1. Commencement

1.1 These Regulations, other than regulations 1, 2 and 26, commence on 10 December 1990.

1.2 Regulations 1, 2 and 26 commence on 1 December 1990.

2. Amendment

2.1 The Migration Regulations are amended as set out in these Regulations.

3. Regulation 2 (Interpretation)

3.1 Subregulation 2 (1) (definition of “equivalent”):

Omit the definition, substitute:

“‘equivalent’, in relation to an entry permit, means the entry permit specified in an item in Schedule 3 by words the same as those specifying a class of visas in Schedule 2;”.

3.2 Subregulation 2 (1):

Insert the following definition:

“‘humanitarian entry permit’ means an entry permit specified as a class 9 entry permit in Schedule 3;”.

3.3 Subregulation 2 (1) (definition of “humanitarian visa”):

Omit all the words after “Lebanese concession visa;”.

3.4 Subregulation 2 (1):

Insert the following definition?

“‘student entry permitmeans an entry permit specified as a Class 3 entry permit in Schedule 3;”.

3.5 Subregulation 2 (1) (definition of “student visa”):

Omit all the words after “Schedule 2”.

3.6 Subregulation 2 (1) (definition of “temporary resident entry permit”):

Omit the definition, substitute:

“‘temporary resident entry permitmeans an entry permit specified as a class 2 entry permit in Schedule 3;”.

3.7 Subregulation 2 (1):

Insert the following definition:

“Visitor entry permit’ means an entry permit specified as a class 4 entry permit in Schedule 3;”.

3.8 Subregulation 2 (2):

Omit “of the class specified in any of the items in Part 2”, substitute “specified in any of items 2, 4, 7, 28, 29, 30, 31, 32 and 33”.

4. Regulation 21 (Classes of entry permits)

4.1 Omit the regulation, substitute:

Classes of entry permits

“21. For the purposes of paragraph 33 (2) (a) of the Act, the classes of entry permits are specified in Schedule 3.”.

5. Regulation 22b (Certain applications for temporary entry permits to have effect as applications for processing entry permits)

5.1 Subregulation 22b (1):

Omit “of a class”.

5.2 Paragraph 22b (1) (a):

After “application”, insert “is made”.

6. Regulation 24 (Grant of entry permit)

6.1 Subregulation 24 (2):

Omit the subregulation, substitute:

“(2) An entry permit is not to be granted:

(a) as a permanent entry permit, unless it is an entry permit specified in Schedule 3:

(i) as a class 1 or class 11 entry permit; or

(ii) as a class 10 entry permit; or

(b) except as a permanent entry permit, if it is an entry permit of a kind referred to in subparagraph (a) (i).”.

6.2 Subregulation 24 (3):

Omit “of a class”.

6.3 Subregulation 24 (3):

Omit “class of entry permits”, substitute “entry permit”.

6.4 Subregulation 24 (3):

Omit “a column”, substitute “the item relating to that entry permit in column 4”.

7. Regulation 29 (Mandatory conditions for grant of entry permits)

7.1 Subregulation 29(1):

Omit “of a class”.

7.2 Subregulation 29 (2):

Omit the subregulation, substitute:

“(2) A reference in Schedule 5 to an entry permit by number is a reference to the entry permit equivalent to a class of visas specified in the correspondingly numbered item in Part 1 in Schedule 2.”.

8. Regulation 34a (Satisfaction of prescribed criteria)

8.1 Subregulation 34a(1):

Omit “or entry permits”, substitute “or the entry permit”.

8.2 Subregulation 34a (2):

Omit “of a class”.

9. Regulation 34b (Entry permit to be subject to conditions of visa or previous entry permit)

9.1 Paragraph 34b (1) (b):

Omit “an equivalent class, or some other class,”, substitute “any class”.

10. Regulation 35aa (Grant of entry permits—illegal entrants)

10.1 Subparagraph 35aa (1) (a) (i):

Omit “relevant class of entry permits”, substitute “entry permit”.

10.2 Subparagraph 35aa(1) (b) (ii):

Omit “relevant class of entry permits”, substitute “entry permit”.

10.3 Subparagraph 35aa (1) (c) (iii):

Omit “relevant class of entry permits”, substitute “entry permit”.

11. Regulation 35b (Extension of time to satisfy requirement or condition)

11.1 Omit all the words after paragraph (e), substitute:

“the Minister may grant:

(f) in the case of the holder of an entry permit—a further entry permit of the same kind; or

(g) in the case of the holder of a visa—an equivalent entry permit;

subject to the satisfaction, within a period specified in that further, or equivalent, entry permit, of the same requirement or condition.”.

12. Regulation 36 (Restriction on re-entry)

12.1 Subregulation 36 (4) (definition of “priority visa”):

Omit “an entry permit of any equivalent class”, substitute “any equivalent entry permit”.

13. Regulation 41 (Prescribed criteria—classes of visas)

13.1 Subregulation 41 (4):

Omit the subregulation, substitute:

“(4) A reference in Schedule 2 to a criterion by an expression comprising a letter or a letter and a number, or by such an expression and a word, or words, in parentheses, is a reference to the criterion so described in Column 3 of Schedule 1.

“(5) An additional criterion (if any) specified in Column 3 in Schedule 2 in relation to a visa of a class specified in Column 2 in that Schedule is prescribed in relation to that class of visas.”.

14. Regulation 42 (Prescribed criteria—classes of entry permits)

14.1 Subregulation 42 (2):

Omit “of a class specified in Part 1, or in items 1 to 11 inclusive or item 14, 16, 17 or 32 in Part 3,”, substitute “specified in any of items 1, 3, 5, 6, 8 to 26 inclusive, 34 to 72 inclusive and 74 to 78 inclusive in Schedule 3”.

14.2 Paragraph 42 (2) (b):

Omit “of a class equivalent to that of the visa”, substitute “equivalent to the class of visa”.

14.3 Subregulation 42 (3):

Omit:

“In relation to the class of entry permits specified in Schedule 3, the following criterion is prescribed, in addition to the criteria prescribed under subregulation (2), on application for a, permit of that class”, substitute:

“The following criterion is prescribed in relation to any class of entry permit specified in Schedule 3, on application for an entry permit of that class”.

14.4 Subregulation 42 (4):

Omit the subregulation, substitute:

“(4) An additional criterion (if any) specified in Column 3 in Schedule 3 in relation to an entry permit specified in Column 2 in that Schedule is prescribed in relation to an entry permit of that kind.”.

14.5 Subregulation 42 (5):

Omit the subregulation, substitute:

“(5) In Schedule 3:

(a) a reference to ‘Reg.’ and a number is a reference to the correspondingly numbered regulation in these Regulations; and

(b) a reference to a criterion by an expression comprising a letter or a letter and a number, or by such an expression and a word, or words, in parentheses, is a reference to the criterion so described in Column 3 of Schedule 1.”.

15. Regulation 43 (Additional criteria)

15.1 Omit the regulation.

16. Regulation 109 (Entry permit for statutory visitor)

16.1 Subregulation 109 (1):

Omit the subregulation, substitute:

“(1) The Minister may grant:

(a) a statutory visitor (territorial asylum) entry permit; or

(b) a statutory visitor (refugee) entry permit;

on application by, or on behalf of, a statutory visitor who is the holder of a statutory visitor visa, if the applicant satisfies the criteria prescribed under subregulation (2).”.

16.2 Subregulation 109 (2):

Omit “of a class”.

17. Regulation 115 (Grant of visa to enable re-entry to Australia)

17.1 Subregulation 115 (2):

Omit “same class”, substitute “same kind”.

18. Regulation 119c (Resident return entry permit)

1.8.1 After “in relation to a”, insert “resident”.

19. Regulation 120 (Grant of temporary entry permit (other than working holiday entry permit) to holders of visitor visa, visitor entry permit or prescribed temporary entry permit)

19.1 Paragraph 120 (f):

Omit “Class of entry permits”, substitute “entry permit”.

19.2 Subparagraph 120 (g) (iii):

Omit “a visa of a class that corresponds to the class of entry permit that includes that entry permit;”, substitute “the class of visas to which that entry permit is equivalent;”.

19.3 Subparagraph 120 (h) (i):

Omit “a visa of a class that corresponds to the class of entry permit that includes that entry permit; and”, substitute “the class of visas to which that entry permit is equivalent; and”.

20. Regulation 121 (Grant of temporary entry permit to holders of working holiday visa or entry permit or of prescribed temporary entry permit)

20.1 Subparagraph 121 (e):

Omit “equivalent to the class of entry permits”, substitute “to which the entry permit is equivalent and”.

20.2 Sub-subparagraph 121 (f) (i) (A):

Omit “equivalent to the class of entry permits”, substitute “to which the entry permit is equivalent and”.

20.3 Sub-subparagraph 121 (f) (ii) (A):

Omit “equivalent to the class of entry permits”, substitute “to which the entry permit is equivalent and”.

20.4 Sub-subparagraph 121 (f) (iii) (A):

Omit “a visa of a class that corresponds to the class of entry permit that includes that entry permit;”, substitute “the class of visas to which that entry permit is equivalent; and”.

21. Regulation 122 (Grant of temporary entry permit to holders of certain student visas or entry permits or of prescribed temporary entry permits)

21.1 Sub-subparagraphs 122 (e) (i) (A), 122 (e) (ii) (E) and 122 (e) (iii) (A):

Omit “that corresponds to the class of entry permit that includes that entry permit”, substitute “to which the entry permit is equivalent”.

22. Regulation 123 (Grant of visitor or student entry permit to holders of certain student visas or entry permits or of prescribed temporary entry permits)

22.1 Omit “permit, or of a valid entry permit, of one of the following classes, namely, student (Equity and Merit Scholarship Scheme), student (AIDAB)”, substitute “permit of one of the following kinds, namely, student (Equity and Merit Scholarship Scheme), student (AIDAB), or of the equivalent valid entry permit,”.

22.2 Sub-subparagraphs 123 (d) (i) (A) and 123 (d) (ii) (A):

Omit “that corresponds to the class of entry permit that includes that entry permit”, substitute “to which the entry permit is equivalent”.

23. Regulation 123a (Holders of trainee (English language), or trainee (non-formal course), entry permits or of certain prescribed temporary entry permits—temporary provisions)

23.1 Subparagraph 123a (3) (a) (i):

Omit “that corresponds to the class of entry permit that includes that entry permit”, substitute “to which the entry permit is equivalent”.

23.2 Paragraph 123a(4) (c):

Omit “class of entry permits”, substitute “entry permit”.

23.3 Sub-subparagraph 123a (5) (b) (i) (C):

Omit “relevant class of.

24. Regulation 124 (Grant of student entry permit to holders of, or persons included in, diplomatic visas or to holders of prescribed temporary entry permits)

24.1 Paragraph 124 (b):

Omit “that corresponds to the class of entry permit that includes that entry permit”, substitute “to which the entry permit is equivalent”.

25. Regulation 125 (Prescribed criteria for grant of temporary entry permit to lawful temporary residents or holders of prescribed temporary entry permits)

25.1 Subparagraphs 125 (e) (i) and (ii) and sub-paragraph 125(e) (iii) (A):

Omit “that corresponds to the class of entry permit that includes that entry permit”, substitute “to which the entry permit is equivalent”.

26. Regulation 126 (Extended eligibility (spouse) entry permit)

26.1 Paragraph 126 (2) (b):

Omit “1 December 1990.”, substitute “31 March 1991”.

27. Regulation 133 (Application of Division)

27.1 Omit “to those classes of entry permits specified in Part 2 in Schedule 3.”, substitute “in relation to an entry permit specified in any of items 2, 4, 7, 28, 29, 30, 31, 32 or 33 in Schedule 3.”.

28. Regulation 144 (Waiver of health criteria)

28.1 Subregulation 144 (1):

Omit “or an entry permit of one of the following classes:”, substitute “of one of the following classes or the equivalent entry permit:”.

28.2 Subregulation 144(2)

Omit “or an entry permit of a class to which this regulation applies”, substitute “of a class to which this regulation applies or the equivalent entry permit:”.

29. Regulation 183 (Fees in respect of grant of visas and entry permits)

29.1 Paragraph 183 (1)(b):

Omit “of a class”.

29.2 Subregulation 183 (2):

Omit the subregulation, substitute:

“(2) No fee is payable in respect of the grant of:

(a) a visa of a class not specified in Schedule 8; or

(b) a visa of a class specified in an item in Schedule 8 in respect of which no fee is specified in that Schedule; or

(c) an entry permit not specified in Schedule 8; or

(d) an entry permit specified in an item in Schedule 8 in respect of which no fee is specified in that Schedule;

unless regulation 185 applies.”.
