Migration Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Migration Act 1958.

1.   Commencement

1.1   These Regulations commence on 1 July 1998.

2.   Amendment

2.1   The Migration Regulations are amended as set out in these Regulations.

3.   Regulation 1.03 (Interpretation)

3.1   Insert the following definition:

‘ETA-eligible passport’ has the meaning given in regulation 1.11B;”.

4.   New regulation 1.11B

4.1   After regulation 1.11A, insert:

ETA-eligible passport

1.11B. (1) A passport is an ETA-eligible passport in relation to an application for a visa if:

  • (a)

    it is a valid passport of a kind specified by Gazette Notice as an ETA-eligible passport; and

  • (b)

    the conditions (if any) specified by Gazette Notice for passports of that kind are satisfied in relation to that application.

 “(2) A passport is an ETA-eligible passport in relation to a visa of a particular Subclass if:

  • (a)

    it is an ETA-eligible passport in accordance with subregulation (1); and

  • (b)

    it is specified by Gazette Notice to be an ETA-eligible passport for that Subclass.”.

5.   Regulation 2.07AB (Applications for Electronic Travel Authority visas)

5.1   Paragraph 2.07AB (2) (a):

Omit the paragraph, substitute:

  • “(a)

    the applicant presents to an officer an ETA-eligible passport;”. 

6.   Schedule 1 (Classes of visas)

6.1   Paragraphs 1208A (3) (c) and (d):

Omit the paragraphs, substitute:

  • “(c)

    Applicant must hold an ETA-eligible passport.”.

7.   Schedule 2, Part 956 (Electronic Travel Authority (Business Entrant—Long Validity))

7.1   Clause 956.221:

Omit the clause, substitute:

“956.221 The applicant holds a passport that is an ETA-eligible passport in relation to this Subclass.”. 

8.   Schedule 2, Part 976 (Electronic Travel Authority (Visitor))

8.1   Clause 976.221:

Omit the clause, substitute:

“976.221 The applicant holds a passport that is an ETA-eligible passport in relation to this Subclass.”. 

9.   Schedule 2, Part 977 (Electronic Travel Authority (Business Entrant—Short Validity))

9.1   Clause 977.221:

Omit the clause, substitute:

“977.221 The applicant holds a passport that is an ETA-eligible passport in relation to this Subclass.”.

10.   Schedule 9 (Special Entry and Clearance Arrangements)

10.1   Part 1:

Omit item 21, substitute:

“21

Persons holding an Electronic Travel Authority (Class UD) visa

  • A passport that is an ETA-eligible passport in relation to the Subclass of the Electronic Travel Authority (Class UD) visa held by the person. 
  • Yes”.
