Migration Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Migration Act 1958.

1.   Commencement

1.1   Regulation 3 commences on 1 May 1992.

1.2   Regulations 4 and 5 commence on 25 May 1992.

1.3   Regulation 8 and subregulations 9.1, 9.2 and 9.4 commence on 1 May 1992.

1.4   Regulations 11 and 12 commence on 25 May 1992.

1.5   Regulations 15 and 16 commence on 1 May 1992.

2.   Amendment

2.1   The Migration Regulations are amended as set out in these Regulations.

3.   Regulation 40 (Prescribed change in circumstances—paragraphs 36 (1) (a) and 37 (2) (a) of the Act)

3.1   Paragraph 40 (1) (t):

Omit the paragraph, substitute:

  • “(t)

    the applicant satisfies the criteria for the grant of a Croatians, Slovenians and Yugoslavs—(temporary) entry permit.”.

4.   Regulation 64 (Exchange visa)

4.1   Subparagraphs 64 (a) (iv) and (v):

Omit the subparagraphs, substitute:

 “(iv) the exchange will benefit the applicant and the resident of Australia;”.

5.   Regulation 66 (Family relationship visa)

5.1   After subparagraph 66 (b) (ii), insert:

 “(iia) a member of the family who is an Australian permanent resident is living with the family; and”.

6.   Regulation 107d (East Timorese in Portugal (special assistance) visa)

6.1   Subparagraph 107d (f) (iii):

Omit “accomodation”, substitute “accommodation”.

7.   Regulation 107f (Minorities of former USSR (special assistance) visa)

7.1   Subparagraph 107f (f) (iii):

Omit “accomodation”, substitute “accommodation”.

8.   Regulation 118 (Croatians, Slovenians and Yugoslavs—(temporary) entry permit)

8.1   Subregulation 118 (1):

Omit “Yugoslav (temporary) entry permit:”, substitute “Croatians, Slovenians and Yugoslavs—(temporary) entry permit:”.

8.2   Paragraph 118 (1) (a):

Omit “Yugoslavia;”, substitute “Croatia, Slovenia or Yugoslavia;”.

8.3   Paragraph 118 (1) (b):

Omit “31 December 1991;”, substitute “30 April 1992;”.

8.4   Paragraph 118 (1) (ba):

Omit “30 April 1992;”, substitute “31 July 1992;”.

8.5   Subregulation 118 (2):

Omit “Yugoslav (temporary) entry permit”, substitute “Croatians, Slovenians and Yugoslavs—(temporary) entry permit”.

8.6   Paragraph 118 (2) (a):

Omit “30 April 1992”, substitute “31 July 1992”.

9.   Regulation 119g (Sri Lankan (temporary) entry permit)

9.1   Paragraph 119g (1) (b):

Omit “31 December 1991;”, substitute “30 April 1992;”.

9.2   Paragraph 119g (1) (ba):

Omit “30 April 1992;”, substitute “31 July 1992;”.

9.3   Paragraphs 119g (1) (c), (d) and (e):

Omit the paragraphs.

9.4   Paragraph 119g (2) (b):

Omit “30 April 1992;”, substitute “31 July 1992;”.

10.   Regulation 119h (PRC (temporary) entry permit)

10.1   Paragraph 119h (1) (a):

Omit “paragraphs (1a) (a) and (b):”, substitute “subregulation (1a);”.

10.2   Paragraph 119h (1a) (a):

Add at the end:

 “; and (iii) described in the applicant’s inwards passenger card, being the card in respect of which the entry permit was issued, as a citizen of the PRC; and

 (iv) described in the applicant’s passport or other travel document on entry as a citizen of the PRC;”.

10.3   Subregulation 119h (1a):

Add at the end:

“; (c)

the Minister is satisfied that the applicant:

 (i) is not entitled to reside in a place outside the PRC; or

  (ii) is not a citizen of a country other than the PRC.”.

11.   Regulation 126 (Extended eligibility (spouse) entry permit

11.1   Paragraph 126 (1a) (a):

Omit the paragraph, substitute:

“(a)

a court:

(i) on the application of the applicant, has granted an injunction against the spouse of the applicant under paragraph 114 (1) (a), (b) or (c) of the Family Law Act 1975; or

 (ii) has made an order under the law of a State or Territory against the spouse of the applicant, being an order for the protection of the applicant from domestic violence; or”.

12.   Regulation 135 (Spouse (after entry) entry permit)

12.1   Subparagraph 135 (3) (b) (i):

Omit the subparagraph, substitute:

 “(i) a court:

(a) on the application of the applicant, has granted an injunction against the spouse of the applicant under paragraph 114 (1) (a), (b) or (c) of the Family Law Act 1975; or

 (b) has made an order under the law of a State or Territory against the spouse of the applicant, being an order for the protection of the applicant from domestic violence; or”.

13.   Regulation 139 (Skilled occupation entry permit)

13.1   Sub-subparagraph 139 (1) (c) (iv) (b):

Omit “applies;”, substitute “applies.”.

13.2   Paragraph 139 (1) (d):

Omit the paragraph.

14.   Regulation 205 (Waiver of fee for visitor visa in certain circumstances)

14.1   Omit “if a Minister certifies that the waiver of the fee would be in the public interest”.

15.   Schedule 3 (Classes of entry permits)

15.1   Class 9, item 82b:

Omit the item, substitute:

“82b

Croatians, Slovenians and Yugoslavs—(temporary)

443”.

16.   Schedule 8 (Fees)

16.1   Part 2, item 14:

Omit the item, substitute:

“14

Croatians, Slovenians and Yugoslavs—(temporary)

$30”.
