Migration Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Migration Act 1958.

1.   Commencement

1.1   Regulations 8 and 13, subregulation 14.1 and regulation 19 commence on 1 October 1992.

1.2   Regulations 16 and 17 are taken to have commenced on 31 July 1992.

1.3   Regulation 18 is taken to have commenced on 1 June 1992.

1.4   Regulation 21 is taken to have commenced on 1 May 1992.

[NOTE: The remaining provisions of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Amendment

2.1   The Migration Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   After the definition of “assurance of support”, insert:

“ ‘AUD’, in relation to an amount of money, means Australian dollars;”.

4.   Regulation 16 (Effect and operation of visas)

4.1   Paragraph 16 (8) (g):

Add at the end:

  • “; or

    (v) subregulation 107b (4).”.

5.   Regulation 17 (Conditions in connection with grant of visas)

5.1   Paragraph 17 (1) (q):

After “business visitor visa”, insert “or a business visitor (short stay) visa”.

6.   Regulation 27 (Effect and operation of entry permits)

6.1   Paragraph 27 (3) (f):

Omit “or paragraph 98e (6) (a).”, substitute “, paragraph 98e (6) (a) or subregulation 107b (4).”.

7.   Regulation 28 (Conditions in connection with grant of temporary entry permits)

7.1   Paragraph 28 (1) (o):

Omit “permit,”, substitute “permit or a business visitor (short stay) entry permit,”.

8.   Regulation 35aa (Grant of entry permit—illegal entrants)

8.1   After subregulation 35aa (2), insert:

 “(2a) Subregulation (2) does not apply in relation to a processing entry permit.”.

9.   Regulation 48a (Business skills visa)

9.1   Subregulation 48a (1):

Definition of “fiscal year”:

Omit “an enterprise,”, substitute “an applicant’s business or principal business,”.

9.2   Subregulation 48a (1):

Paragraph (a) of the definition of “fiscal year”:

Omit “enterprise”, substitute “business”.

9.3   Subregulation 48a (1):

Paragraph (b) of the definition of “fiscal year”:

Omit “enterprise.”, substitute “business or principle business.”.

9.4   Paragraph 48a (2) (aa):

Omit “at least 3”, substitute “3 or more”.

9.5   Paragraph 48a (2) (aa):

9.6   Paragraph 48a (2) (aa):

9.7   Paragraph 48a (2) (aa):

    in any 3 fiscal years in the 4 fiscal years immediately preceding the making of the application, the net assets of a business, or the businesses, of:

    • (i)

      the applicant; and

    • (ii)

      the applicant and his or her spouse together;

 were not less than the equivalent of AUD 350,000 in each of those years; and”.

9.9   Paragraph 48a (2) (c):

Omit “each of 3”, substitute “any 3”.

9.10   Paragraph 48a (2) (c):

Omit “the applicant, as the sole proprietor of, or as a shareholder in, the applicant’s principal business,”, substitute “the applicant”.

9.11   Paragraph 48a (2) (c):

Omit “the business”, substitute “the applicant’s principal business”.

9.12   Paragraph 48a (2) (c):

9.13   Subparagraph 48a (2) (f) (ii):

Omit “involvement, as the sole proprietor of, or as a shareholder in, the business,”, substitute “involvement”.

10.   Regulation 48b (Business skills (senior executive) visa)

10.1   Subregulation 48b (1) (definition of“fiscal year”):

Omit “an enterprise,”, substitute “a major business,”.

10.2   Subregulation 48b (1):

Paragraph (a) of the definition of “fiscal year”:

Omit “enterprise”, substitute “business”.

10.3   Subregulation 48b (1):

11.   Regulation 87b (Occupational trainee visa)

11.1   Paragraph 87b (1) (c):

After “lodged”, insert “and approved”.

12.   Regulation 95 (Return visa, Class B)

12.1   Paragraph 95 (a):

Omit the paragraph.

13.   Regulation 98b (Student (category A) visa)

13.1   Paragraph 98b (1) (d):

Omit the paragraph.

14.   Regulation 98d (Student (category B) visa)

14.1   Paragraph 98d (1) (d):

Omit the paragraph.

14.2   After sub-subparagraph 98d (3) (a) (i) (c), insert:

 “(ca) is a person who is normally resident in, and who has an unlimited right of re-entry to, a country specified by the Minister by notice in the Gazette as a country to which this sub-subparagraph applies; or”.

15.   Regulation 107b (PRC (temporary) visa)

15.1   Paragraph 107b (1) (a):

Omit the paragraph, substitute:

  • “(a)

    in the case of an applicant who holds a PRC (temporary) entry permit:

    • (i)

      the applicant is in Australia at the time of making the application; and

    • (ii)

      if the applicant is not the spouse or a dependent child of a person who holds a PRC (temporary) entry permit or visa—the applicant has made a written declaration to the Secretary that the applicant does not intend to travel to the PRC while he or she holds a PRC (temporary) visa; or”.

15.2   Subregulation 107b (4):

Omit the subregulation, substitute:

“(4)

A PRC (temporary) visa issued to an applicant who is not the spouse or a dependent child of a person who holds a PRC (temporary) entry permit or visa is subject to the terminating condition that the person must not travel to the PRC.”.

16.   Regulation 118 (Citizens of the former Socialist Federal Republic of Yugoslavia (temporary) entry permit)

16.1   Paragraph 118 (1) (ba):

Omit “31 July 1992;”, substitute “31 January 1993;”.

16.2   Paragraph 118 (2) (a):

17.   Regulation 119g (Sri Lankan (temporary) entry permit)

    in the case of an applicant for a December 1989 (temporary) entry permit or a December 1989 (permanent) entry permit—the applicant apparently meets the prescribed criteria in relation to the entry permit applied for, other than public interest criteria and prescribed health criteria;”.

19.7   Subparagraph 131 (f) (iii):

Omit the subparagraph, substitute:

  • “(iii)

    the applicant apparently meets the prescribed criteria in relation to the entry permit applied for, other than public interest criteria and prescribed health criteria.”.

20.   Regulation 140 (Family and other close ties entry permit)

20.1   Paragraph 140 (1) (c):

Omit the paragraph, substitute:

  • “(c)

    in the case of an applicant referred to in paragraph (2) (a)—the Minister has accepted an assurance of support for the applicant that meets the criterion set out in item 2 in Schedule 1;".

21.   Schedule 5 (Mandatory conditions for grant of visas and entry permits)
