CLASS OF PERSONS – PUBLIC INTEREST CRITERIA – RISK FACTOR
(PARAGRAPH 4011(2)(b))
I, CHRIS EVANS, Minister for Immigration and Citizenship, acting under regulation 1.17 of the Migration Regulations 1994 (‘the Regulations’):
(1) REVOKE Gazette Notice 50 of 20 December 2000, signed on 12 December 2000, specifying risk factor groups for the purposes of paragraph 4011(2)(b) of Schedule 4 to the Regulations; and
(2) SPECIFY, for the purposes of paragraph 4011(2)(b) of Schedule 4 to the Regulations, the classes of persons described in the Schedule to this Instrument, where each row of the Schedule is a separate item and each item is a separate class.
This Instrument, IMMI 08/033, commences on the day after registration on the Federal Register of Legislative Instruments.

[NOTE: (1) Part 1 of Schedule 4 to the Regulations relates to public interest criteria. Clause 4011 provides for the circumstance where an applicant is affected by the risk factor specified in subclause 4011(2). Paragraph 4011(2)(b) of Schedule 4 provides that an applicant is affected by the risk factor, referred to in subclause 4011(1), if the applicant has all the characteristics of a class of persons specified by the Minister by Gazette Notice for the purposes of paragraph 4011(2)(b).]
