THAILAND, IRAN, CHILE, TURKEY, UNITED STATES OF AMERICA, MALAYSIA, INDONESIA AND BANGLADESH

(ITEM 1224A AND PARAGRAPH 462.221(c))

I, PAULA WILLIAMS, Assistant Secretary, Education and Training Branch, Delegate of the Minister for Immigration and Citizenship, acting under item 1224A of Schedule 1 and paragraph 462.221(c) of Schedule 2 to the Migration Regulations 1994 (‘the Regulations’):

  1. REVOKE Instrument number IMMI 09/065, signed on 14 June 2009, specifying foreign countries, educational qualifications and addresses for the purposes of item 1224A of Schedule 1 to the Regulations and paragraph 462.221(c) of Schedule 2 to the Regulations.

  1. SPECIFY for the purpose of paragraph 1224A(3)(a) of Schedule 1 to the Regulations the following foreign countries AND SPECIFY for the purposes of paragraph 462.221(c) of Schedule 2 to the Regulations the educational qualifications in relation to the corresponding specified foreign country:

[NOTE 1: Paragraph 1224A(3)(a) of Schedule 1 to the Regulations provides that an applicant for a Work and Holiday (Temporary) (Class US) visa must hold a valid passport issued by a foreign country specified in an instrument in writing.

NOTE 2: Paragraph 1224A(3)(aa) of Schedule 1 to the Regulations provides that, subject to paragraph 1224A(3)(ab), an application for a Work and Holiday (Temporary) (Class US) visa made using form 1208 by a person who holds a valid passport mentioned in paragraph 1224A(3)(a) must be made at an address specified for the country of issue in an instrument in writing.

NOTE 3: Paragraph 1224A(3)(ab) of Schedule 1 to the Regulations provides that an application for a Work and Holiday (Temporary) (Class US) visa made using form 1208 by a person in a class of persons specified in an instrument in writing may be made in any foreign country.

NOTE 4: Subregulation 2.10(2) of Division 2.2 of Part 1 of the Regulations provides that where an application for a visa is made outside Australia, and there are no further requirements as to where the application must be made in Division 2.2 of Part 1 of the Regulations, or the item in Schedule 1 to the Regulations that relates to the visa, the application must be made at a diplomatic, consular or migration office maintained by or on behalf of the Commonwealth outside Australia.

NOTE 5: Paragraph 462.221(c) of Schedule 2 to the Regulations provides that an applicant must be the holder of an educational qualification specified in an instrument in writing, in relation to the foreign country that issued the passport mentioned in paragraph 462.221(aa), which refers to paragraph 1224A(3)(a).]
