WORKING HOLIDAY VISA - DEFINITIONS OF ‘SEASONAL WORK’ AND ‘REGIONAL AUSTRALIA’
(REGULATION 1225(5))
I, AMANDA VANSTONE, Minister for Immigration and Multicultural Affairs, acting under regulation 1.17 and subitem 1225(5) of Schedule 1 to the Migration Regulations 1994 (‘the Regulations’):
1.REVOKE Instrument Number IMMI 06/014, signed on 11 May 2006, specifying the definitions of seasonal work and regional Australia for the purposes of subitem 1225(5) of the Regulations;
2.SPECIFY the areas having the postcodes listed in the Schedule to this Instrument as being regional Australia for the purposes of subitem 1225(5) of Schedule 1 to the Regulations; AND
3.SPECIFY, for the purposes of subitem 1225(5) of Schedule 1 to the Regulations, seasonal work to be any type of work that is undertaken as the employee of a primary producer, including:
(a) plant and animal cultivation
(i)the harvesting and/or packing of fruit and vegetable crops
(ii)pruning and trimming vines and trees
(iii)general maintenance crop work
(iv)cultivating or propogating plants, fungi or their products or parts
(v)immediate processing of plant products
(vi)maintaining animals for the purpose of selling them or their bodily produce, including natural increase
(vii)immediate processing of animal products including shearing, butchery, packing and tanning
(viii)manufacturing dairy produce from raw material
(b) fishing and pearling
(i)conducting operations relating directly to taking or catching fish and other aquatic species
(ii)conducting operations relating directly to taking or culturing pearls or pearl shell
(c) tree farming and felling
(i)planting or tending trees in a plantation or forest that are intended to be felled
(ii)felling trees in a plantation or forest, or
(iii)transporting trees or parts of trees that were felled in a plantation or forest to the place where they are first to be milled or processed or from which they are to be transported to the place where they are to be milled or processed.
This Instrument, IMMI 06/069, commences on the day of registration on the Federal Register of Legislative Instruments.
