VISA SUBCLASSES FOR THE PURPOSES OF THE HEALTH REQUIREMENT 2016/046

(Clauses 4005, 4006A and 4007)

I, PETER DUTTON, Minister for Immigration and Border Protection, acting under my power in subparagraph 4005(2)(b)(ii), subparagraph 4006A(1A)(b)(ii) and subparagraph 4007(1A)(b)(ii) of the Migration Regulations 1994 (the Regulations):

1. REVOKE Instrument IMMI 12/025, Visa Subclasses for the Purposes of the Health Requirement, signed on 12 June 2012; and

2. SPECIFY:

   a.under subparagraph 4005(2)(b)(ii) for the purposes of subparagraph 4005(1)(c)(i) of the Regulations; or

   b.under subparagraph 4006A(1A)(b)(ii) for the purposes of subparagraph 4006(1)(c)(i) of the Regulations; or

   c.under subparagraph 4007(1A)(b)(ii) for the purposes of subparagraph 4007(1)(c)(i) of the Regulations;

   the following current visa subclasses:

   i.for applicants who have satisfied subitem 1216(3A) of the Regulations,  Subclass 159 – Provisional Resident Return;

   ii.Subclass 173 - Contributory Parent (Temporary);

   iii.Subclass 188 – Business Innovation and Investment (Provisional);

   iv.Subclass 300 - Prospective Marriage;

   v.Subclass 309 - Partner (Provisional);

   vi.Subclass 445 - Dependent Child;

   vii.Subclass 457 – Temporary Work (Skilled);

   viii.Subclass 489 - Skilled - Regional Sponsored (Provisional);

   ix.Subclass 820 – Partner; and

   x.Subclass 884 - Contributory Aged Parent (Temporary).

3. SPECIFY:

   a.under subparagraph 4005(2)(b)(ii) for the purposes of subparagraph 4005(1)(c)(i) of the Regulations; or

   b.under subparagraph 4006A(1A)(b)(ii) for the purposes of subparagraph 4006(1)(c)(i) of the Regulations; or

   c.under subparagraph 4007(1A)(b)(ii) for the purposes of subparagraph 4007(1)(c)(i) of the Regulations;

   the following former visa subclasses:

   i.Subclass 160 - Business Owner (Provisional);

   ii.Subclass 161 - Senior Executive (Provisional);

   iii.Subclass 162 - Investor (Provisional);

   iv.Subclass 163 - State / Territory Sponsored Business Owner (Provisional);

   v.Subclass 164 - State / Territory Sponsored Senior Executive (Provisional);

   vi.Subclass 165 - State / Territory Sponsored Investor (Provisional);

   vii.Subclass 309 - Spouse (Provisional);

   viii.Subclass 310 - Interdependency (Provisional),

   ix.Subclass 457 - Business (Long Stay) – as defined at subclause 457.223(7);

   x.Subclass 475 - Skilled Regional Sponsored;

   xi.Subclass 487 - Skilled - Regional Sponsored;

   xii.Subclass 495 - Skilled - Independent Regional (Provisional);

   xiii.Subclass 496 - Skilled - Designated Area-sponsored (Provisional);

   xiv.Subclass 826 – Interdependency.

This Instrument, Visa Subclasses for the purposes of the Health Requirement 2016/046, IMMI 16/046, commences on 1 July 2016.
