SPECIFICATION OF TRANSIT PASSENGERS FOR THE PURPOSES OF REGULATION 2.40(1)(n) OF THE MIGRATION REGULATIONS 1994

I, AMANDA VANSTONE, Minister for Immigration and Multicultural and Indigenous Affairs, acting under regulations 1.17 and 2.40(l)(n) of the Migration Regulations 1994 (‘the Regulations’), hereby:

1. REVOKE  the notice signed on 25 December 2001; and

1. SPECIFY transit passengers who belong to a class of persons specified in Attachment A to this instrument as a class of persons for the purposes of subparagraph 2.40(1)(n) of the Regulations.

[NOTE 1: Regulation 1.17 of the Migration Regulations provides that the Minister may, by notice published in the Gazette, specify matters required by individual provisions of the Regulations to be specified for the purposes of those provisions.

NOTE 2: Regulation 2.40(1)(n) of the Migration Regulations provides that transit passengers who belong to a class of persons are specified in a Gazette Notice.]

(d)  Diplomatic passport holders, excluding holders of:

·    Arab Non-National Passports; and

·    Diplomatic passports from the following foreign countries:
