SKILLED AUSTRALIAN SPONSORED (MIGRANT) VISA:
RESIDENTIAL POSTCODES, “SKILLED OCCUPATIONS” AND POINTS
(REGULATIONS 1.03 AND 2.26B)
I, JOHN COBB, Acting Minister for Immigration and Multicultural and Indigenous Affairs, acting under regulations 1.17 and 1.03 and subregulation 2.26B(1) of the Migration Regulations1994 (‘the Regulations’):
1. REVOKE the Gazette Notices signed on 31 August 2004 and 29 March 2005 specifying skilled occupations for the purposes of the definition of “skilled occupation” in regulation 1.03 and relevant assessing authorities for the purposes of subregulation 2.26B(1) of the Regulations;
2. SPECIFY each occupation that is in the Sydney and Selected Areas Skilled Shortage List referred to in Schedule A to this notice as a skilled occupation for the purposes of subparagraph (a)(iii) of the definition of “skilled occupation” in regulation 1.03 of the Regulations;
3. SPECIFY the number of points referred to in Schedule A to this notice for the corresponding occupation set out in Schedule A, for the purposes of subparagraph (a)(iv) of the definition of “skilled occupation” in regulation 1.03 of the Regulations;
4. SPECIFY each body referred to in Schedule A to this notice as the relevant assessing authority for the corresponding skilled occupation set out in Schedule A, for the purposes of subregulation 2.26B(1) of the Regulations;
5. SPECIFY the postcodes listed in Schedule B to this notice, for the purposes of subparagraph (a)(i) of the definition of “skilled occupation” in regulation 1.03 of the Regulations;
6. SPECIFY each occupation referred to in Schedule C to this notice as a skilled occupation for the purposes of paragraph (b) of the definition of “skilled occupation” in regulation 1.03 of the Regulations;
7. SPECIFY the number of points referred to in Schedule C to this notice for the corresponding occupation set out in Schedule C, for the purposes of paragraph (b) of the definition of “skilled occupation” in regulation 1.03 of the Regulations; AND
8. SPECIFY each body referred to in Schedule C to this notice as the relevant assessing authority for the corresponding skilled occupation set out in Schedule C, for the purposes of subregulation 2.26B(1) of the Regulations.
This Instrument takes effect on and from 1 November 2005.

[NOTE 1: Regulation 1.17 provides that the Minister may, by notice published in the Gazette, specify matters required by individual provisions of the Regulations to be specified for the purposes of those provisions.
NOTE 2: Paragraph (a) of the definition of “skilled occupation” in regulation 1.03 of the Regulations, provides that, in relation to an applicant for a Skilled Australian Sponsored (Migrant) (Class BQ) visa, a “skilled occupation” means an occupation that is in the Sydney and Selected Areas Skilled Shortage List specified by Gazette Notice, for which a number of points specified in the Notice are available and whose sponsor has, on the sponsorship form, stated a residential address the postcode of which is specified in that Notice.
NOTE 3: Paragraph (b) of the definition of “skilled occupation” in regulation 1.03 of the Regulations, provides that, in any other case, a “skilled occupation” means an occupation that is specified by Gazette Notice as a skilled occupation for which a number of points specified in the Notice are available.
NOTE 4: Regulation 1.03 provides that “relevant assessing authority” means a person or body specified under regulation 2.26B.
NOTE 5: Subregulation 2.26B(1) provides the Minister may, by notice in the Gazette, specify a person or body as the relevant assessing authority for a skilled occupation if the person or body is approved in writing by the Minister or NOOSR as the relevant assessing authority for the occupation.]
