RESIDENTIAL POSTCODES, SKILLED OCCUPATIONS, RELEVANT ASSESSING AUTHORITIES AND POINTS
(REGULATIONS 1.03 AND 2.26B)
I, AMANDA VANSTONE, Minister for Immigration and Multicultural Affairs, acting under regulation 1.03 and subregulation 2.26B(1) of the Migration Regulations1994 (‘the Regulations’):
1. REVOKE Instrument number IMMI 06/035, signed on 19 June 2006, specifying residential postcodes, skilled occupations, relevant assessing authorities and points under the Skilled Australian Sponsored (Migrant) visa under regulation 1.03 and subregulation 2.26B(1) of the Regulations;
2. SPECIFY each occupation that is in the Sydney and Selected Areas Skilled Shortage List referred to in Schedule A to this Instrument as a skilled occupation for the purposes of subparagraph (a)(iii) of the definition of skilled occupation in regulation 1.03 of the Regulations;
3. SPECIFY the number of points referred to in Schedule A to this Instrument for the corresponding occupation set out in Schedule A, for the purposes of subparagraph (a)(iv) of the definition of skilled occupation in regulation 1.03 of the Regulations;
4. SPECIFY each body referred to in Schedule A to this Instrument as the relevant assessing authority for the corresponding skilled occupation set out in Schedule A, for the purposes of subregulation 2.26B(1) of the Regulations;
5. SPECIFY the postcodes listed in Schedule B to this Instrument, for the purposes of subparagraph (a)(i) of the definition of skilled occupation in regulation 1.03 of the Regulations;
6. SPECIFY each occupation referred to in Schedule C to this Instrument as a skilled occupation for the purposes of paragraph (b) of the definition of skilled occupation in regulation 1.03 of the Regulations;
7. SPECIFY the number of points referred to in Schedule C to this Instrument for the corresponding occupation set out in Schedule C, for the purposes of paragraph (b) of the definition of skilled occupation in regulation 1.03 of the Regulations; AND
8. SPECIFY each body referred to in Schedule C to this Instrument as the relevant assessing authority for the corresponding skilled occupation set out in Schedule C, for the purposes of subregulation 2.26B(1) of the Regulations.
This Instrument, IMMI 06/062, commences on 1 November 2006.

[NOTE 1: Paragraph (a) of the definition of skilled occupation in regulation 1.03 of the Regulations, provides that, in relation to an applicant for a Skilled Australian Sponsored (Migrant) (Class BQ) visa, a skilled occupation means an occupation that is in the Sydney and Selected Areas Skilled Shortage List specified in an instrument in writing, for which a number of points specified in the instrument are available and whose sponsor has, on the sponsorship form, stated a residential address the postcode of which is specified in the instrument.
NOTE 2: Paragraph (b) of the definition of skilled occupation in regulation 1.03 of the Regulations, provides that, in any other case, a skilled occupation means an occupation that is specified in an instrument in writing as a skilled occupation for which a number of points specified in the instrument are available.
NOTE 3: Regulation 1.03 provides that relevant assessing authority means a person or body specified under regulation 2.26B.
NOTE 4: Subregulation 2.26B(1) provides that the Minister may, by an instrument in writing for this subregulation, specify a person or body as the relevant assessing authority for a skilled occupation if the person or body is approved in writing by the Minister or Education as the relevant assessing authority for the occupation.
NOTE 5: Education is defined in regulation 1.03 as the Department of Education, Science and Training.]
