ARRANGEMENTS FOR OTHER FAMILY VISA APPLICATIONS 2015

(Items 1123A and 1123B)

I, MICHAELIA CASH, Assistant Minister for Immigration and Border Protection, acting under subregulation 2.07(5) of the Migration Regulations 1994 (the Regulations) for items 1123A and 1123B of Schedule 1 to the Regulations:

SPECIFY, for subitems 1123A(1) and 1123B(1) of Schedule 1 to the Regulations, the following approved forms and for subitems 1123A(3) and 1123B(3), the place and manner for making an application:

Subclass 115 (Remaining Relative);

The application must be made outside Australia.

Item 1123B

Other Family (Residence)(Class BU) visa

Subclass 835 (Remaining Relative);
Subclass 836 (Carer);
Subclass 838 (Aged Dependent Relative)

The application must be made in Australia, but not in immigration clearance.

Note 1: Subregulation 2.10(2) provides that if  an application is made outside Australia -  and there are no requirements in Part 2 or Schedule 1to the Regulations about where to apply - the  application must be made at a diplomatic, consular or migration office maintained by or on behalf of the Commonwealth outside Australia.

Note 2: Subregulation 2.10(2A) provides that if  an application is made in Australia  - and there are no requirements in Part 2 or Schedule 1to the Regulations about where to apply - the  application must be made at an office of Immigration in Australia.

This Instrument, number IMMI 15/034, commences on 18 April 2015.
