AREAS FOR BUSINESS INNOVATION AND INVESTMENT (PERMANENT) VISA AND

STATE AND TERRITORY SPONSORED BUSINESS OWNER VISA

(Subparagraph 888.226(2)(c)(i) and paragraph 892.213(3)(b))

I, CHRIS BOWEN, Minister for Immigration and Citizenship, acting under subparagraph 888.226(2)(c)(i) and paragraph 892.213(3)(b) of Schedule 2 to the Migration Regulations 1994 (“the Regulations”):

1. REVOKE Instrument IMMI 12/032, signed on 12 June 2012, specifying postcodes and postcode ranges, as being areas for the purposes of subparagraph 888.226(b)(i) and paragraph 892.213(3)(b) of Schedule 2 to the Regulations; AND

2. SPECIFY the postcodes and postcode ranges listed in the Schedule to this Instrument as being areas for the purposes of subparagraph 888.226(2)(c)(i) and paragraph 892.213(3)(b) of Schedule 2 to the Regulations.

This Instrument, IMMI 12/118, commences on 24 November 2012 immediately after the commencement of the Migration Legislation Amendment Regulation 2012 (No. 5).

[NOTE 1:   Subparagraph 888.226(2)(c)(i) provides that, as a criterion for the Business Innovation Stream of the Business Innovation and Investment (Permanent) visa, an applicant must reside in an area specified by the Minister in an instrument in writing for that subparagraph.    

NOTE 2:    Paragraph 892.213(3)(b) provides that, as a criterion for a State/Territory Sponsored Business Owner visa, an applicant must reside in, and operate the applicant’s main business or businesses in Australia in, an area specified by the Minister in an instrument in writing for that paragraph.]
