OCCUPATIONS, LOCATIONS, SALARIES, AND RELEVANT ASSESSING AUTHORITIES FOR THE EMPLOYER NOMINATION SCHEME

(REGULATIONS 5.19(2)(h) AND (i), 121.211(b), AND 856.213(b))

I, AMANDA VANSTONE, Minister for Immigration and Multicultural Affairs, acting under regulation 1.17, paragraph 5.19(2)(i) and subparagraphs 5.19(2)(h)(i) and (ii) of the Migration Regulations 1994 (‘the Regulations’), and subparagraphs 121.211(b)(ii) and 856.213(b)(ii), and sub-subparagraphs 121.211(b)(i)(A) and 856.213(b)(i)(A), of Schedule 2 to the Regulations:

1.    REVOKE Instrument number IMMI 05/007, signed on 17 March 2005, specifying occupations, locations, salaries, and relevant assessing authorities, for the purposes of the same provisions as this Instrument;

2.    SPECIFY each occupation listed in column 1 of the Schedule to this Instrument for the purposes of subparagraph 5.19(2)(h)(i) of the Regulations;

3.    SPECIFY each person or body listed in column 2 of the Schedule to this Instrument as the relevant assessing authority for the corresponding occupation listed in column 1 for the purposes of sub-subparagraphs 121.211(b)(i)(A) and 856.213(b)(i)(A) of Schedule 2 to the Regulations;

4.    SPECIFY all of Australia as the location for each occupation listed in column 1 of the Schedule to this Instrument for the purposes of subparagraph 5.19(2)(h)(ii) of the Regulations;

5.    SPECIFY each base annual salary amount listed in column 3 of the Schedule to this Instrument for the corresponding occupation listed in the Schedule and the location specified in paragraph 4 of this Instrument for the purposes of paragraph 5.19(2)(i) of the Regulations; AND

6.    SPECIFY the base annual salary amount of AUD165,000 for the purposes of subparagraphs 121.211(b)(ii) and 856.213(b)(ii) of Schedule 2 to the Regulations.

This Instrument, IMMI 06/027, takes effect on the day after it is registered on the Federal Register of Legislative Instruments.

[NOTE 1:   Regulation 1.17 provides that the Minister may, by notice published in the Gazette, specify matters required by individual provisions of these Regulations to be specified for the purposes of those provisions.

NOTE 2:    Regulation 5.19 deals with approval of nominated positions (employer nominations). Subparagraph 5.19(2)(h)(i) relevantly provides that the tasks to be performed in the nominated position must correspond to the tasks of an occupation specified in a Gazette Notice in force for this subparagraph at the time at which the application for approval of the nominated position is made.

NOTE 3:    Subparagraph 5.19(2)(h)(ii) provides that the tasks to be performed in the nominated position will be carried out in a location specified, for the relevant occupation, in a Gazette Notice in force for this subparagraph at the time at which the application for approval of the nominated position is made.

NOTE 4:    Paragraph 5.19(2)(i) provides that the employee will be paid a salary in the nominated position that is at least the salary specified, for the relevant occupation and location, in a Gazette Notice in force for this paragraph at the time at which the application for approval of the nominated position is made.

NOTE 5:    Subparagraphs 121.211(b)(ii) and 856.213(b)(ii) provide the applicant will be paid a salary in the nominated position that is at least the amount of salary specified in a Gazette Notice for these subparagraphs.

NOTE 6:    Sub-subparagraphs 121.211(b)(i)(A) and 856.213(b)(ii) provide an assessing authority specified by the Minister in a Gazette Notice for these sub-subparagraphs as the assessing authority for the occupation to which the appointment relates has assessed the applicant’s skills as suitable.]
