1Name

This instrument is the Migration (Migration Agents Code of Conduct) Consequential Amendments Regulations 2021.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Migration Act 1958.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments commencing day after registration

Migration Agents Regulations 1998

Before paragraph 3V(a)

Insert:

1. (aa)

   the registered migration agent’s migration agent registration number;

Regulation 6B

Before “For the”, insert “(1)”.

At the end of regulation 6B

Add:

1. (2)

   In this regulation:

employee includes:

1. (a)

   a person engaged as a consultant or as an independent contractor; and

2. (b)

   a person engaged as a volunteer.

Schedule 2Amendments commencing 1 March 2022

Subparagraph 7A(b)(i)

Omit “, including copies of the documents described in clause 6.1 of Schedule 2”.

Paragraph 7B(4)(e)

Omit “in Schedule 2”, substitute “prescribed for the purposes of subsection 314(1) of the Act”.

Subparagraph 7F(b)(i)

Omit “, including copies of the documents described in clause 6.1 of Schedule 2”.

Regulation 8

Repeal the regulation.

Schedule 2

Repeal the Schedule.
