1  Name

(1)     This instrument is the Migration (LIN 21/001: Payment of Visa Application Charges and Fees in Foreign Currencies) Instrument 2021.

(2)     This instrument may be cited as LIN 21/001.

2  Commencement

This instrument commences on 1 January 2021.

3  Authority

This instrument is made under paragraph 5.36(1A)(a) of the Migration Regulations 1994.

4  Definitions

Note 1:       visa application charge has the same meaning as defined in subsection 5(1) of the Migration Act 1958.

Note 2:       fee has the same meaning as in subregulation 5.36(4) of the Regulations.

In this instrument:

ISO means International Organization for Standardization.

Regulations means the Migration Regulations 1994.

VAC means visa application charge.

5  Schedules

The instrument specified in Schedule 2 to this instrument is repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

6  Exchange rates for payment of VAC, and fees, in foreign currencies

For the purposes of paragraph 5.36(1A)(a) of the Regulations:

(a)     each currency mentioned for an item in Column 1 of the table in Schedule 1 is specified; and

(b)     the exchange rate mentioned in Column 3 of the table in Schedule 1 for that item is specified.
