Part 1—Preliminary

1  Name

(1)This instrument is the Migration (LIN 19/199: Arrangements for Visitor (Class FA) Visa Applications) Instrument 2019. 

(2)This instrument may be cited as LIN 19/199.

3  Authority

This instrument is made under subregulation 2.07(5) of the Regulations and subitem 1236(6) of Schedule 1 to the Regulations.

4  Definitions

In this instrument:

Department means the Department of Home Affairs.

PRC means the People’s Republic of China.

Regulations means the Migration Regulations 1994.

5  Purpose

This instrument is made for the purposes of item 1236 of Schedule 1 to the regulations and specifies arrangements for a person making an application for a Visitor (Class FA) visa.

Part 2 – Making a Visitor (Class FA) visa application

6  Making an application in the Tourist stream

(1)   For subitem 1236(1) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 1, the approved form is specified in the corresponding row in Column B; and

(2)   For the item 1 of the table in subitem 1236(3) of Schedule 1 to the Regulations for each kind of applicant described in Column A of the table in Schedule 1, the place and manner for making an application is specified in the corresponding row in Column C.

7  Making an application in the Sponsored Family stream

(1)   For subitem 1236(1) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 2, the approved form is specified in the corresponding row in Column B; and

(2)   For item 1 of the table in subitem 1236(4) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 2, the place and manner for making an application is specified in the corresponding row in Column C.

8  Making an application in the Business Visitor stream

(1)   For subitem 1236(1) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 3, the approved form is specified in the corresponding row in Column B; and

(2)   For item 1 of the table in subitem 1236(5) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 3, the place and manner for making an application is specified in the corresponding row in Column C.

9  Making an application in the Approved Destination Status stream

(1)   For subitem 1236(1) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 4, the approved form is specified in the corresponding row in Column B;

(2)   For item 4 of the table in subitem 1236(6) of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 4, the place and manner for making an application is specified in the corresponding row in Column C; and

(3)   For item 3 of the table in subitem 1236(6) of Schedule 1 to the Regulations, the travel agents in Schedule 5 are specified.

10  Making an application in the Frequent Traveller stream

(1)   For subitem 1236(1), of Schedule 1 to the Regulations, for each kind of applicant described in Column A of the table in Schedule 6, the approved form is specified in the corresponding row in Column B;

(2)   For subitem 1236(6A) of Schedule 1 to the Regulations:

(a)    for item 1 of the table in the subitem - for each kind of applicant described in Column A of the table in Schedule 6, the place and manner for making an application is specified in the corresponding row in Column C;

(b)    for paragraph (b) of item (2) of the table in the subitem - the PRC is a specified place.

(c)   for item 3 of the table in the subitem - the applicant must hold a valid passport of the PRC, indicating that the applicant is a national of the PRC.

The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.

The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.

Editorial changes

The Legislation Act 2003 authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.

If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.

Misdescribed amendments

A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.

If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.
