Part 1 – Preliminary

1  Name

(1)This instrument is the Migration (IMMI 18/084: Specification of ETA-Eligible Passports) Instrument 2018.

(2)This instrument may be cited as IMMI 18/084.

2  Commencement

This instrument commences on the day after registration on the Federal Register of Legislation.

3  Authority

This instrument is made under regulation 1.11B(1) of the Migration Regulations 1994.

4  Definitions

In this instrument:

ETA means Electronic Travel Authority.

Regulations means the Migration Regulations 1994.

5  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2 – Specified ETA-Eligible Passports

6  ETA- Eligible Passports

For the purposes of subregulation 1.11B(1) of the Regulations, a passport is an ETA-eligible passport in relation to an application for a visa if in the table in Schedule 1:

(a)    the passport is listed in Column 1; and

(b)   the conditions specified in Column 2 for the corresponding passport specified in Column 1 are satisfied.

Part 3 – Application

7  Application of this instrument

This instrument applies to an application for a visa made on or after the commencement of this instrument.

Schedule 1—ETA-Eligible passport list

2.	Austria	Passport must indicate that the applicant is a national of Austria
3.	Belgium	Passport must indicate that the applicant is a national of Belgium
4.	Brunei	Passport must indicate that the applicant is a national of Brunei
5.	Canada	Passport must indicate that the applicant is a national of Canada
6.	Denmark	Passport must indicate that the applicant is a national of Denmark
7.	Finland	Passport must indicate that the applicant is a national of Finland
8.	France	Passport must indicate that the applicant is a national of France
9.	Germany	Passport must indicate that the applicant is a national of Germany
10.	Greece	Passport must indicate that the applicant is a national of Greece
11.	Hong Kong Special Administrative Region, People’s Republic of China	Nil
12.	Iceland	Passport must indicate that the applicant is a national of Iceland
13.	Republic of Ireland	Passport must indicate that the applicant is a national of the Republic of Ireland
14.	Italy	Passport must indicate that the applicant is a national of Italy
15.	Japan	Passport must indicate that the applicant is a national of Japan
16.	Republic of Korea	Passport must indicate that the applicant is a national of the Republic of Korea
17.	Liechtenstein	Passport must indicate that the applicant is a national of Liechtenstein
18.	Luxembourg	Passport must indicate that the applicant is a national of Luxembourg
19.	Malaysia	Passport must indicate that the applicant is a national of Malaysia
20.	Malta	Passport must indicate that the applicant is a national of Malta
21.	Monaco	Passport must indicate that the applicant is a national of Monaco
22.	The Netherlands	Passport must indicate that the applicant is a national of The Netherlands
23.	Norway	Passport must indicate that the applicant is a national of Norway
24.	Portugal	Passport must indicate that the applicant is a national of Portugal
25.	Republic of San Marino	Passport must indicate that the applicant is a national of the Republic of San Marino
26.	Singapore	Passport must indicate that the applicant is a national of Singapore
27.	Spain	Passport must indicate that the applicant is a national of Spain
28.	Switzerland	Passport must indicate that the applicant is a national of Switzerland
29.	Sweden	Passport must indicate that the applicant is a national of Sweden
30.	Passports issued by the authorities of Taiwan	Passports must not purport to be official passports or diplomatic passports
31.	United Kingdom of Great Britain and Northern Ireland	Passport must indicate that the applicant’s nationality is British Citizen or British National (Overseas)
32.	United States of America	Passport must indicate that the applicant is a national of the United States of America
33.	Vatican City	Nil
