Part 1—Preliminary

1. Name

   (1)   This instrument is the Migration (IMMI 18/030: Class of Persons and Specified Events for Class GG Visa and Subclass 408 (Temporary Activity) Visa) Instrument 2018.

   (2)   This instrument may be cited as IMMI 18/030.

2  Commencement

This instrument commences on the day after it is registered on the Federal Register of Legislation.

3  Authority

This instrument is made under the following provisions of the Regulations:

(a)subregulation 2.07(5);

(b)paragraph 408.229(b) of Schedule 2; and

(c)paragraph 408.229(c) of Schedule 2.

4  Definitions

Note:    A number of expressions used in this instrument are defined in the Regulations, including the following:

(a)eligible sponsor;

(b)eligible supporter.

In this instrument:

accredited participant in the Invictus Games means a person who is accredited by the Australian International Military Games to participate in the Invictus Games Sydney 2018 and who is a class of persons for the purposes of subsection 8(1) of this instrument;

ASEAN means Association of Southeast Asian Nations;

Regulations means Migration Regulations 1994.

5  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2—Specified class of persons and events

6  Class of persons for subparagraph 1237(2)(a)(i)

(1)   For the purposes of subparagraph 1237(2)(a)(i) of Schedule 1 to the Regulations, the classes of persons at subsections (2) and (3) are specified.

(2)   An applicant who is:

(a)  a delegate accredited by the Department of Prime Minister and Cabinet to attend the ASEAN Australia Special Summit 2018; or

(b)  an accredited participant in the Invictus Games Sydney 2018.

(3)  An applicant seeking to satisfy the criterion in clause 408.219A of Schedule 2 to the Regulations where clause 408.229A applies and where:

(a)  there is an eligible sponsor or eligible supporter who is:

(i)      a charity registered by the Australian Charities and Not-for-profits Commission;

(ii)     an agency of the Commonwealth;

(iii)   an agency of a State;

(iv)   an agency of a Territory;

(v)     an agency, Embassy or Consulate of a foreign government;

(vi)   the Australian Romantic and Classical Orchestra;

(vii)     the Queensland Art Gallery and Gallery of Modern Art;

(viii)   the Australian Grand Prix where the sponsorship or support relates to the Formula One Australian Grand Prix or the Australian Motorcycle Grand Prix;

(ix)   PI SBK Pty Ltd where the sponsorship or support relates to Superbike events;

(x)     Major Brisbane Festivals Pty Ltd; or

(xi)   DarkLab Pty Ltd where the sponsorship or support relates to the Dark Mofo Festival; and

(b)   the applicant will only engage in entertainment activities that are organised by, or on behalf of, an eligible sponsor or eligible supporter listed in paragraph (a).

7  Specified events for paragraph 408.229(b)

(1)  For the purposes of paragraph 408.229(b) of Schedule 2 to the Regulations, the following events are specified:

(a)  the ASEAN Australia Special Summit 2018; or

(b)  the Invictus Games Sydney 2018.

8  Class of persons for paragraph 408.229(c)

(1)  For the purposes of paragraph 408.229(c) of Schedule 2 to the Regulations, the following classes of persons are specified in relation to an event in subsection 7(1) of this instrument:

(a)    a delegate accredited by the Department of Prime Minister and Cabinet to attend the ASEAN Australia Special Summit 2018;  

(b)  an accredited participant in the Invictus Games Sydney 2018;

(c)  an Invictus Games 2018 Participating Nations Team member, including:
competitors; team managers; Family and Friends Program managers;
coaches; team officials; interpreters and translators; medical staff; support   
staff; and military Media Personnel;

(d)  a spouse or de facto partner of a competitor; a parent of a competitor; a  
sibling of a competitor; a child of a competitor; or a friend of a competitor;

(e)  an Invictus Games Foundation Delegation member; a spouse or de facto partner of an Invictus Games Foundation Delegation member; or a child of an Invictus Games Foundation Delegation member; or

(f)  an Invictus Games specialist staff member.
