Part 1—Preliminary

1  Name

(1)  This instrument is the Migration (IMMI 18/007: Specification of Occupations and Assessing Authorities) Instrument 2018.

(2)This instrument may also be cited as IMMI 18/007.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under the following provisions of the Migration Regulations 1994:

(a)  regulation 1.03;

(b)  subregulation 1.15I(1);

(c)  subregulation 2.26B(1);

(d)  subitem 1137(4C) of Schedule 1;

(e)  item 4 of the table in subitem 1138(4) of Schedule 1;

(f)  paragraph 1229(3)(k) of Schedule 1;

(g)  item 4 of the table in subitem 1230(4) of Schedule 1.

4  Definitions

Note:          A number of expressions used in this instrument are defined in the Regulations, including skilled occupation.

In this instrument:

applicable list has the meaning given by subsection 7(2) of this instrument.

Medium and Long‑term Strategic Skills List means the table in subsection 8(1) of this instrument.

nec is short for not elsewhere classified.

Regulations means the Migration Regulations 1994.

Short‑term Skilled Occupation List means the table in subsection 9(1).

5  Meaning of ANZSCO

For the purposes of regulation 1.03 of the Regulations, ANZSCO means the Australian and New Zealand Standard Classification of Occupations published by the Australia Bureau of Statistics, as in force on 17 January 2018.

6  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2—Specification of occupations and assessing authorities

7  Specification of occupations and assessing authorities

Scope of this section

(1)  This section applies to a class of persons mentioned in column 1 of an item of the following table:

(a) persons who are issued an invitation on or after 17 January 2018 to make an application for a Subclass 189 (Skilled—Independent) visa; and

(b) persons who are issued an invitation on or after 17 January 2018 to make an application for a Subclass 489 (Skilled—Regional (Provisional)) visa and who are not nominated by a State or Territory government agency; and

(c) spouses or de facto partners of persons mentioned in paragraph (a) or (b)

(a) persons who:

(i) are nominated by a State or Territory government agency; and

(ii) are issued an invitation on or after 17 January 2018 to make an application for a Subclass 190 (Skilled—Nominated) visa or Subclass 489 (Skilled—Regional (Provisional)) visa; and

(b) spouses or de facto partners of persons to whom paragraph (a) applies; and

(c) persons who:

(i) are the spouses or de facto partners of persons who are nominated by a State or Territory government agency; and

(ii) are issued an invitation on or after 17 January 2018 to make an application for a Subclass 190 (Skilled—Nominated) visa or Subclass 489 (Skilled—Regional (Provisional)) visa

(a) Medium and Long‑term Strategic Skills List; and

(b) Short‑term Skilled Occupation List

Meaning of applicable list

(2)  A list mentioned in column 2 of the item is an applicable list for the class.

Specification of occupations

(3)  For the purposes of paragraph 1.15I(1)(a) of the Regulations, each occupation mentioned in column 1 of an item of an applicable list for the class is specified to be a skilled occupation for the class, subject to subsections 8(2) and 9(2) of this instrument.

(4)  For the purposes of paragraph 1.15I(1)(c) of the Regulations, the occupation is applicable to each member of the class.

(5)  If the occupation is a skilled occupation in relation to a member of the class, the skilled occupation is specified:

(a)  if item 1 of the table in subsection (1) of this section applies—for the purposes of item 4 of the table in subitem 1137(4B), and item 4 of the table in subitem 1230(4), of Schedule 1 to the Regulations, as a skilled occupation; or

(b)  if item 2 of the table in subsection (1) of this section applies—for the purposes of paragraph 1229(3)(k) of Schedule 1 to the Regulations; or

(c)  if item 3 of the table in subsection (1) of this section applies—for the purposes of item 4 of the table in subitem 1138(4), and item 4 of the table in subitem 1230(4), of Schedule 1 to the Regulations, as a skilled occupation.

Specification of assessing authorities

(6)  For the purposes of subregulation 2.26B(1) of the Regulations, if the occupation is a skilled occupation in relation to a member of the class, a person or body listed in column 3 of the item of the applicable list is specified as the relevant assessing authority for:

(a)  the skilled occupation; and

(b)  all countries;

for the purposes of an application for a skills assessment made by a resident of one of those countries.

1  The whole of the instrument

Repeal the instrument.

Part 2—Application of repeal

1 Application of repeal

Despite the repeal of the Migration (IMMI 17/072: Specification of Occupations and Assessing Authorities) Instrument 2017 (the repealed instrument) by Part 1 of this Schedule, the repealed instrument, as in force immediately before the commencement of that Part, continues to apply in relation to the following:

(a)each person included in a class of persons mentioned in column 1 of  items 1 and 3 in the table in subsection 6(1) of the repealed instrument, if the invitation mentioned in those items is issued before 17 January 2018;

(b)a person included in the class of persons mentioned in column 1 of item 2 in the table in subsection 6(1) of the repealed instrument, if the visa application mentioned in that item is made by that person before 17 January 2018.
