Part 1 – Preliminary

1  Name

(1)   This instrument is the Migration (IMMI 17/127: Arrangements for Temporary Work and Temporary Activity Visa Applications) Instrument 2017.

(2)   This instrument may be cited as IMMI 17/127.

2  Commencement

This instrument commences on 18 November 2017. 

3  Authority

This instrument is made under subregulation 2.07(5) of the Regulations.

4  Definitions

In this instrument:

Regulations means the Migration Regulations 1994.

5  Schedules

Each instrument that is specified in a Schedule to this instrument is repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2 - Arrangements for Temporary Work and Temporary Activity Visa Applications

6  Making an application—Investor Retirement (Class UY) visa

(1)  For the purposes of subitem 1212B(1) and paragraph 1212B(3)(a) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A of the table in Schedule 1 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

7  Making an application—Retirement (Temporary) (Class TQ) visa

(1)  For the purposes of subitem 1217(1) and paragraph 1217(3)(a) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A of the table in Schedule 2 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

8  Making an application—Temporary Work (Short Stay Specialist) (Class GA) visa

(1)  For the purposes of subitem 1231(1) and paragraph 1231(3)(a) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A of the table in Schedule 3 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

9  Making an application—Temporary Work (International Relations)
(Class GD) visa

(1)  For the purposes of subitem 1234(1) and paragraph 1234(3)(a) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A in the table in Schedule 4 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

10  Making an application—Temporary Activity (Class GG) visa

(1)  For the purposes of subitem 1237(1) and item 1 of the table in subitem 1237(3) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A in the table in Schedule 5 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

11  Making an application—Training (Class GF) visa

(1)  For the purposes of subitem 1238(1) and item 1 of the table in subitem 1238(3) of Schedule 1 to the Regulations, for each kind of applicant specified in Column A in the table in Schedule 6 to this instrument:

(a)  the approved form is specified in the corresponding row in Column B; and

(b)  the place and manner for making an application is specified in Column C.

b)    in accordance with the directions set out in the email authorising the use of form 1403, before midnight (AEST or AEDST when applicable) on the day following the date on which the authorising email was sent by (an officer of) the Department of Immigration and Border Protection.

An applicant who is seeking to satisfy the criteria for a Temporary Work (International Relations) (Class GD) visa in any stream other than the Seasonal Worker Program stream.

b)   in accordance with the directions set out in the email authorising the use of form 1403, before midnight (AEST or AEDST when applicable) on the day following the date on which the authorising email was sent by (an officer of) the Department of Immigration and Border Protection; or

c)   if the applicant is outside Australia, the authorised application may also be made at a diplomatic, consular or migration office maintained by or on behalf of the Commonwealth outside Australia.

An applicant who is claiming to be a member of the family unit of a person who already holds a Temporary Work (International Relations) (Class GD) visa in the Government Agreement stream, the Foreign Government Agency stream or the Privileges and Immunities stream.

b)  in accordance with the directions set out in the email authorising the use of form 1481, before midnight (AEST or AEDST when applicable) on the day following the date on which the authorising email was sent by (an officer of) the Department of Immigration and Border Protection; or

c)  if the applicant is outside Australia, the authorised application may also be made at a diplomatic, consular or migration office maintained by or on behalf of the Commonwealth outside Australia.
