Part 1—Preliminary

1  Name

This is the Migration (IMMI 16/022: Priority Consideration of Certain Visa Applications) Instrument 2016.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subregulation 2.12M(7) of the Migration Regulations 1994.

4  Definitions

Note:          A number of expressions used in this instrument are defined in the Regulations, including the following:

(a) Immigration;

(b) outside Australia.

In this instrument:

Regulations means the Migration Regulations 1994.

5  Priority consideration of visa applications—general matters

For subregulation 2.12M(2) of the Regulations, the following table specifies the following:

(a)  kinds of visas (column 1);

(b)  kinds of valid passports in relation to kinds of visas specified for the item (column 2);

(c)  requirements in relation to kinds of visas and kinds of valid passports specified for the item (column 3);

(d)  approved forms in relation to kinds of visas and kinds of valid passports specified for the item (column 4);

(e)  ways in which applications can be made in relation to kinds of visas, kinds of valid passports and approved forms specified for the item (column 5).

1 Subclass 600 (Visitor) visa in the Tourist Stream Passports issued by the People’s Republic of China indicating that the applicant is a national of the People’s Republic of China Applicant must be outside Australia when the request for priority consideration of the visa application is made Form 1419 By making the application at an Australian Visa Application Centre in the People’s Republic of China that is specified on Immigration’s website
2 Subclass 600 (Visitor) visa in the Business Visitor Stream Passports issued by the People’s Republic of China indicating that the applicant is a national of the People’s Republic of China Applicant must be outside Australia when the request for priority consideration of the visa application is made Form 1415 By making the application at an Australian Visa Application Centre in the People’s Republic of China that is specified on Immigration’s website

For subregulation 2.12M(5) of the Regulations, the following table specifies, in relation to kinds of visas (column 1) and kinds of valid passports (column 2), the following:

(a)  approved forms (column 3);

(b)  ways in which requests for priority consideration of visa applications can be made (column 4).
