1Name of instrument

This instrument is the Migration Amendment (Temporary Graduate Visas) Regulation 2014.

2Commencement

This instrument commences on 6 October 2014.

3Authority

This instrument is made under the Migration Act 1958.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Part 1—Main amendments

Migration Regulations 1994

1  Subclause 1229(10) of Schedule 1

Omit “(Skilled—Graduate)”, substitute “(Temporary Graduate)”.

2  Subclause 485.224(1) of Schedule 2

Repeal the subclause, substitute:

            (1)  The skills of the applicant for the applicant’s nominated skilled occupation have been assessed, during the last 3 years, by a relevant assessing authority as suitable for that occupation.

         (1A)  If the assessment is expressed to be valid for a particular period, that period has not ended.

Add:

Part 33—Amendments made by the Migration Amendment (Temporary Graduate Visas) Regulation 2014

3301  Operation of Part 1 of Schedule 1

The amendments of these Regulations made by Part 1 of Schedule 1 to the Migration Amendment (Temporary Graduate Visas) Regulation 2014 apply in relation to the following applications for a visa:

                    (a)  an application made on or after 1 July 2014, but not finally determined before 6 October 2014;

                    (b)  an application made on or after 6 October 2014.
