1Name

This instrument is the Migration Amendment (Substituted Subclass 600 Visa Exemptions) Regulations 2025.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Migration Regulations 1994

Paragraph 1124A(3)(bc) of Schedule 1

Repeal the paragraph, substitute:

1. (bc)

   An applicant seeking to satisfy the primary criteria must be:

   1. (i)

      an aged parent; or

   2. (ii)

      the holder of a substituted Subclass 600 visa at the time of application.

Paragraph 1130A(3)(cb) of Schedule 1

Repeal the paragraph, substitute:

1. (cb)

   An applicant seeking to satisfy the primary criteria must be:

   1. (i)

      an aged parent; or

   2. (ii)

      the holder of a substituted Subclass 600 visa at the time of application.

Paragraph 1221A(3)(cb) of Schedule 1

Repeal the paragraph, substitute:

1. (cb)

   An applicant seeking to satisfy the primary criteria must be:

   1. (i)

      an aged parent; or

   2. (ii)

      the holder of a substituted Subclass 600 visa at the time of application.

Insert:

15201Operation of amendments

The amendments of these Regulations made by Schedule 1 to the Migration Amendment (Substituted Subclass 600 Visa Exemptions)Regulations 2025 apply in relation to an application for a visa made on or after the commencement of that Schedule.
