1Name of Regulations

 These Regulations are the Migration Amendment Regulations 2000 (No. 3).

2Commencement

 These Regulations commence, or are taken to have commenced, as follows:

  • (a)

    on 28 April 2000 — regulations 1 to 3 and Schedule 1;

  • (b)

    on 1 July 2000 — Schedule 2.

3Amendment of Migration Regulations 1994

 Schedules 1 and 2 amend the Migration Regulations 1994.

866.227 (1)   The applicant meets the requirements of subclause (2) or (3).

 (2)   The applicant meets the requirements of this subclause if the applicant, or a member of the family unit of the applicant, has not been offered a temporary stay in Australia by the Australian Government for the purposes of regulation 2.07AC.

(3) The applicant meets the requirements of this subclause if section 91K of the Act does not apply to the applicant’s application because of a determination made by the Minister under subsection 91L (1) of the Act.
