1Name of regulation

This regulation is the Migration Amendment (Internet Applications and Related Matters) Regulation 2013.

2Commencement

This regulation commences on 23 November 2013.

3Authority

This regulation is made under the Migration Act 1958.

4Schedule(s)

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Migration Regulations 1994

1  Paragraph 2.12C(7)(b)

Repeal the paragraph, substitute:

                   (b)  these Regulations provide that the application may be made as an Internet application; and

2  Paragraph 1114B(2)(b) of Schedule 1 (table item 2)

Repeal the item, substitute:

Applicant:

(a) who was at least 18 at the time of application; and

(b) who is assessed as not having functional English; and

(c) who satisfies the secondary criteria for the grant of a Subclass 186 (Employer Nomination Scheme) visa; and

(d) to whom item 3 does not apply

3  Paragraph 1114C(2)(b) of Schedule 1 (table item 2)

Repeal the item, substitute:

Applicant:

(a) who was at least 18 at the time of application; and

(b) who is assessed as not having functional English; and

(c) who satisfies the secondary criteria for the grant of a Subclass 187 (Regional Sponsored Migration Scheme) visa; and

(d) to whom item 3 does not apply

4  Paragraph 1124B(3)(ca) of Schedule 1

After “An application”, insert “(not being an Internet application)”.

5  Subparagraph 1124B(3)(e)(ii) of Schedule 1

After “form 40SP”, insert “or 40SP (Internet)”.

6  At the end of subitem 1128(2) of Schedule 1

Add:

Note:       Regulation 2.12C explains the components of the first instalment of visa application charge and specifies the amounts of subsequent temporary application charge and non‑Internet application charge. Not all of the components may apply to a particular application.

              Additional applicant charge is paid by an applicant who claims to be a member of the family unit of another applicant and seeks to combine the application with that applicant’s application.

7  Paragraph 1129(3)(a) of Schedule 1

After “Application”, insert “(not being an Internet application)”.

8  Paragraph 1129(3)(f) of Schedule 1

After “An application”, insert “(not being an Internet application)”.

9  Paragraph 1214C(3)(fa) of Schedule 1

After “An application”, insert “(not being an Internet application)”.

10  Paragraph 1215(3)(a) of Schedule 1

11  Paragraph 1220A(3)(a) of Schedule 1

12  Sub‑subparagraph 1231(2)(a)(ii)(C) of Schedule 1

Renumber as sub‑subparagraph (B).

13  At the end of subitem 1236(2) of Schedule 1

Add:

2401  Operation of Schedule 1

The amendments of these Regulations made by Schedule 1 to the Migration Amendment (Internet Applications and Related Matters) Regulation 2013 apply in relation to an application for a visa made on or after 23 November 2013.
