I, the Minister for Planning and Infrastructure, make the following local environmental plan under the Environmental Planning and Assessment Act 1979.

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Mid-Western Regional Local Environmental Plan 2012 (Amendment

No 8).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at 285 Botobolar Road, Botobolar, being Lots 28 and 29,

DP 755414.

4 Amendment of Mid-Western Regional Local Environmental Plan 2012

Schedule 1, Additional permitted uses

Insert the following clause with appropriate numbering:

Use of certain land at 285 Botobolar Road, Botobolar

(1)

This clause applies to land at 285 Botobolar Road, Botobolar, being

Lots 28 and 29, DP 755414.

(2)

Development for the purpose of a dwelling house is permitted with

development consent subject to:

(a)

Lots 28 and 29, DP 755414 being consolidated into a single lot, and

(b)

evidence being provided to the consent authority that sufficient water is available for the development of the site for intensive plant agriculture, and

(c)

a water licence for the water referred to in paragraph (b) having been granted, and

(d)

at least 50% of the proposed intensive plant agriculture venture on the site having been established.
