AN ACT to amend the Metropolitan Water Supply,
Sewerage, and Drainage Act 1909-1981.
[Assented to 30 October 1981.]
BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Section 41
| amended. | 2. Section 41 of the principal Act is amended |
| (a) | by deleting "The Board may turn or cut off" and substituting the following |
it
(1) The Board may turn or cut off or reduce the available rate of flow of "
| (b) | by deleting "Turning or cutting off the water" and substituting the following |
'C (2) Turning or cutting off or
reducing the available rate of flow of
the water supply to land " ; and
| (c) | by inserting at the end of the section the following subsection |
f(
(3) Where under this section the Board has turned or cut off or reduced the available rate of flow of the water supply to land, the Board may, before restoring the water supply, require payment of the amount of such charges as the Board may from time to time determine in respect of
| (a) | the turning or cutting off or reduction; and |
| (b) | the restoration of the water supply. |
| Validation. | 3. Where prior to the coming into operation of this Act the Board has reduced the available rate of flow of the water supply to land or has demanded and received payment of any amount of money in respect of turning or cutting off or reducing the available rate of flow of the water supply to land or in respect of restoring the water supply to land, such reduction is declared to have been lawfully effected and such money shall be deemed to have been lawfully demanded and received. |
