An Act to amend the Second Schedule to the Metropolitan Water, Sewerage, and Drainage Act, 1924, to extend the area of operations of The Metropolitan Water Sewerage and Drainage Board to the City of Blue Mountains; and to enact provisions consequent upon that extension. [Assented to, 10th December,
1979.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—
1. This Act may be cited as the "Metropolitan Water, Sewerage, and Drainage (Blue Mountains) Amendment Act, 1979".
(1) Except as provided in subsection (2), this Act shall commence on the date of assent to this Act.

(2) Section 3 shall commence on 1st July, 1980.
The Second Schedule to the Metropolitan Water, Sewerage,
and Drainage Act, 1924, is amended by omitting the word
"Blacktown" and by inserting instead the following words :—

Blue Mountains (City)
(1) The Governor may, by proclamation—
(a)
provide for all matters necessary for, consequential upon or incidental to the extension of the area of operations of The Metropolitan Water Sewerage and Drainage Board to the City of Blue Mountains; and
(b)
provide for any matter or thing in relation to the extension that the Governor may deem necessary or expedient in the circumstances.

(2) Without limiting the generality of subsection ( 1 ) , the provisions referred to in that subsection may include provisions for or relating t o—
(a)
the transfer of assets, rights and liabilities, the transfer of servants, the levying of rates and charges, the recovery of rates and charges, contracts, agreements and under takings entered into by the council of the City of Blue Mountains, and suits, actions and proceedings pending immediately before 1st July, 1980, at the suit of that council; and
(b)
the entering into of agreements and making of arrange ments between The Metropolitan Water Sewerage and Drainage Board and that council and the enforcing and giving effect to of any such agreement or arrangement.
(3) A proclamation under this section—
(a) shall have the force of law;
(b) may be made either before, on or after 1st July, 1980;
(c) shall be published in the Gazette;
(d)
shall take effect on and from the date of publication or a later date specified in the proclamation; and
(e) may be rescinded or varied by a subsequent proclamation.
The Metropolitan Water Sewerage and Drainage Board may levy rates under the Metropolitan Water, Sewerage, and Drainage- Act, 1924, in respect of land in the City of Blue Mountains for the 12 months' period commencing 1st July, 1980, notwithstanding that at the time those rates are levied the City of Blue Mountains is not within the area of operations of that Board.

(1) A local rate or loan rate levied under the Local Government Act, 1919, by the council of the City of Blue Mountains in connection with works of water supply or sewerage operated or to be operated by that council shall, notwithstanding anything to the contrary in that Act, not be levied for the year commencing on 1st January, 1980, but may be levied for the period commencing on that date and ending on 30th June, 1980.
(2) The Local Government Act, 1919, shall, in respect of a rate levied in accordance with subsection (1), be deemed to be amended by omitting from section 160AA (4) (a) (ii), (4) (b) (ii), (6) (a) (ii) and (6) (b) (ii) the matter "$60" wherever occurring and by inserting instead the matter "$30".
