An Act to amend the Metropolitan Water. Sewerage, and Drainage Act, 1924-1943, in certain respects; and for purposes connected therewith. [Assented to, 8th December, 1944.] BE

METROPOLITAN WATER, SEWERAGE, AND

DRAINAGE (AMENDMENT) ACT.

Act No. 37, 1944.

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis­	Wales in Parliament assembled, and by the authority of
the same, as follows :—
1. (1) This Act may be cited as the "Metropolitan Water, Sewerage, and Drainage (Amendment) Act,
1944. " (2) The Metropolitan Water, Sewerage, and Drain­
age Act, 1924, as amended by subsequent Acts and by this Act, may be cited as the Metropolitan Water, Sewerage, and Drainage Act, 1924-1944.

2. The Metropolitan Water, Sewerage, and Drainage

Act, 1924-1943, is amended—

(a) by omitting from the definition of "Area of operations" in section four the words " a n d such other areas as are proclaimed from time to time as areas within which the board is autho­ rised to exercise its powers or perform its functions" and by inserting in lieu thereof the words "and such other areas or parts of areas as may from time to time be declared by pro­ clamation to be within the area of operations";

(b) (i) by inserting in subsection two of section

eight after the word " a r e a s " the words " o r

parts of a r e a s " ;

(ii)   by inserting in subsection three of the same section after the word " a r e a s " wherever

occurring the words " o r parts of a r ea s " ;
(iii)	by inserting at the end of subsection four of the same section the words " I n this sub­ section 'areas comprised therein' shall not include areas parts only of which are included in a constituency pursuant to this A c t " ;

(c) by inserting at the end of section nine the words "This section shall not apply to any person so eligible for election as an alderman or councillor of any area part only of which is comprised in any constituency under this Act ."

(d)	by inserting in subsection tAvo of section thirty ] after the word " a r e a s " where secondly and thirdly occurring the words "o r parts of a r e a s " ;
(e)	by inserting next after section thirty-six the following new section:—

36A. The Governor may by proclamation declare that any area or part of an area shall be within the area of operations of the board.

Any such proclamation shall take effect from the date of publication thereof in the Gazette or from a later date specified therein.

Any such proclamation shall specify the con- stituency in the Second Schedule to this Act within which the area or part of an area so declared to be within the area of operations of the board shall be included and the said Schedule shall be deemed to be amended accordingly. The said Schedule as so amended shall be the Second Schedule to this Act.

A proclamation under this section shall not be made unless the council of the area to which such proclamation relates has previously been consulted with reference to the extension of the area of operations of the board to the area or part of the area, as the case may be.
