METROPOLITAN WATER,

SEWERAGE, AND DRAINAGE

(AMENDMENT) ACT.

Act No. 4, 1931.

An Act to amend the law as to the levying of stormwater drainage rates by the Metro­ politan Water. Sewerage, and Drainage Board; to amend the Metropolitan Water, Sewerage, and Drainage Act, 1924-1930, in certain respects; and for purposes connected therewith. [Assented to, 16th February, 1931.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis­	Wales in Parliament assembled, and by the authority of
the same, as follows :—
1. (1) This Act may be cited as the " Metropolitan Water, Sewerage, and Drainage (Amendment) Act,
1931. "
(2) This Act shall be read with the Metropolitan Water, Sewerage, and Drainage Act, 1924-1930, which Act is in this Act referred to as the Principal Act.

2. The Principal Act is amended as follows:—

(a) by inserting in section four in the definition of " Stormwater channe l" after the words " to be constructed" the words " b y the board or transferred to, acquired by, or vested in i t " ;

(b) (i) by omitting from section sixty-five the

words " As soon as pract icable;"

(ii)  by inserting in the same section after the word " acquired " the words " or altered " ;

(iii)  by omitting from paragraph (a) of the same section the word " sha l l " and by inserting in lieu thereof the words " may

from time to time " ; (iv)

(iv)   by omitting from the same paragraph the word " also " ;

(v)  by inserting in paragraph (b) of the same section after the word " which " the words " any part of" ;

(vi)  by inserting in paragraph (c) of the same section after the word " appeal " the words " within the time and " ;

(vii)   by omitting paragraph (d) of the same section and inserting in lieu thereof the following new paragraph :—

(d) the board shall notify in the Gazette and in one or more newspapers cir­ culating in the drainage area, the day and place of hearing of appeals and of confirmation or alteration of the boundaries of the drainage area or zones.

(viii) (a) by inserting in subparagraph four of paragraph (e) of the same section after the word " f o r m " the words " a n d within the time " ;

(b) by inserting at the end of subparagraph five of the same paragraph the words " a n d that if no appeal is made, the magistrate will confirm or alter the boundaries of the drainage area and zones" ;

(c) by inserting in section ninety-one after the words " levied in respect of" the words " different drainage areas or."

3. As soon as practicable after the passing of this Act, and not later than the thirtieth day of June, one thousand nine hundred and thirty-one, the board shall delimit zones within the Rose Bay Stormwater Drainage Area and shall make and levy rates, which may be differential rates, in respect of such zones.
