AN ACT to amend the Metropolitan (Perth)

Passenger Transport Trust Act, 1957.

[Assented to 6th October, 1960.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation.	1. (1) This Act may be cited as the Metropolitan (Perth) Passenger Transport Trust Act Amendment Act, 1960.
(2) In this Act the Metropolitan (Perth) Passen- ger Transport Trust Act, 1957, is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Metropolitan (Perth) Passenger Transport Trust Act, 1957-1960.

2. Section eight of the principal Act is amended— amended.

(a)	by adding after the word, "subsection" in line three of paragraph (a) of subsection (5), the passage, "and to subsection (7) of this section";
(b)	by adding after paragraph (d) of subsection

(6) the following paragraph-

(da) he is, through mental or physical infirmity, or sickness unable satis- factorily to carry out the duties and perform the functions of his office;

(c) by adding after subsection (6) the following subsection:—

(7) Where a term of tenure of office

terminates before the day on which it would have expired by eilluxion of time, the Governor may appoint a person, or may appoint in succession such greater number of persons if more appointments than one are necessary, in order to fill the office until that day.

3. Section ten of the principal Act is amended amended.

(a)	by inserting immediately after the section number, "10" in line one, the subsection designation, "(1)";
(b)	by adding after the word, "offices" in the last line, the words, "and thereafter from time to time as the Governor may think fit";

(c) by adding a subsection as follows:

(2) The first determination of the remuneration payable under this section which the Governor makes after the coming into operation of the Metropolitan (Perth) Passenger Transport Trust Act Amendment Act, 1960, shall be deemed to have been made on the first day of February, one thousand nine hundred and sixty, and notwithstanding the provisions of subsection (1) of this section the remuneration so determined to be payable in respect of the respective offices of members of the Trust shall be payable on and from that day.

amended. 5. Section thirteen of the principal Act is amended by inserting after the word, "Act" in line six the passage, ", or the provisions of any other Act apply to him as a public servant."
