[A ssented to 28 th N ovember , I960.] B E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Assemblyof Queensland in Parliament assembled, and by the authority of the same, as follows:— 1 . This Act may be cited as “ The Metropolitan short title. Fire Brigades Board {Lands) Act of 1960.” 2. As from the commencement and by virtue of Termination this Act, the freehold lands under “ The Real Property torfuesxtsis. ting Acts, 1861 to 1959,” described in Parts I., If. and III. of the Schedule to this Act shall be absolutely discharged

No. 26, from the trusts upon and subject to which such lands were theretofore vested in and held by The Metropolitan Fire Brigades Board, and shall be dealt with as prescribed by this Act. Authority to sell and purchase. 3. (1.) The Governor in Council may, in the name of Her Majesty, sell to The Metropolitan Fire Brigades Board, and the said Board may purchase for an estate in fee-simple, the land described in Part I. of the Schedule to this Act completely freed and discharged from the trusts upon and subject to which that land was vested in and held by the said Board before the commencement of this Act but, save those trusts, subject to any and every mortgage, charge, encumbrance, lien, lease, easement, agreement, license or other transaction affecting that land or any portion or parcel thereof, and subject also to the several conditions and reservations contained in and declared by “ The Land Acts, 1910 to 1959,” “ The Mining on Private Land Acts, 1909 to 1956,” and “ The Petroleum Acts, 1923 to 1958.” (2.) The purchasing price of the land the salo and purchase of which is authorised by subsection one of this section shall be twenty-two thousand pounds. Certain 4. As from the commencement and by virtue of ilnanBdosavreds. ted this Act the lands described in Parts II. and III. of the Schedule to this Act shall vest in The Metropolitan Fire Brigades Board for an estate in fee-simple completely freed and discharged from the trusts upon and subject to which those lands were vested in and held by the said Board before the commencement of this Act but, save those trusts, subject to any and every mortgage, charge, encumbrance, lien, lease, easement, agreement, license or other transaction affecting those lands or any portion or parcel thereof, and subject also to the several conditions and reservations contained in and declared by “ The Land Acts, 1910 to 1959,” “ The Mining on Private Land Acts, 1909 to 1956,” and “ The Petroleum Acts, 1923 to 1958.”

Subject to The Metropolitan Fire Brigades Board ^jj!^®eds paying the appropriate deed and assurance fees and, in respect of the land described in Part I. of the Schedule to this Act, the purchasing price of twenty-two thousand pounds, the Governor in Council shall issue three Deeds of Grant comprising respectively— (а) the land described in Part I. of the Schedule to this Act; ( б ) the land described in Part II. of the Schedule to this Act; and (c) the land described in Part III. of the Schedule to this Act. 6 . Upon the enrolment of the Deeds of Grant Cancellation issued pursuant to section five of this Act under the Deeds of8 provisions and for the purposes of “ The Real Property certificate Acts , 1861 to 1959,” the Registrar of Titles shall cancelof Title- Deeds of Grant Number 112185, Volume 1589, Folio 195 and Number 135629, Volume 2748, Folio 139 and Certificate of Title Number 278426, Volume 1544, Folio 166. The Registrar of Titles shall endorse upon the relevant Deed of Grant issued pursuant to section five of this Act any subsisting endorsement upon either of the Deeds of Grant or the Certificate of Title cancelled by him under the authority of this section.
