No. 31 of 1972 An Act to take account of the adop t ion of units of the metric system of measurement as legal units of measurement of the Commonwealth ; to amend specified Acts in certain particulars ; to provide for the construction of references to measurement of physical quantities and other references in Acts and instruments and for related purposes. [ASSENTED To 21ST DECEMBER, 1972] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Metric Conversion Act 1972.

264 Metric Conversion Act 1972, No. 31 2. Arrangement of Act. This Act is divided into Parts, as follows:- PART I-PRELIMINARY; PART 1I-AMENDMENT OF REFERENCES TO MEASURE; PART 111-CONSTRUCTION OF REFERENCES TO MEASURE; PART IV-MISCELLANEOUS PROVISIONS; SCHEDULES. 3. Interpretation . (1) In this Act, unless a contrary intention appears- appropriate unit of measurement " means, in relation to a physical quantity, that unit of measurement prescribed by regulations made under the Weights and Measures (NationalStandards) Act1960-1966 of the Commonwealth, as amended from time to time, or under any Act of the Commonwealth in substitution for that Act, as the unit of measurement of that physical quantity; " instrument " means Letters Patent and other documents made in relation to the State of Queensland by or on behalf of the Crown, and Proclamations, Orders in Council, regulations, rules, by-laws, and ordinances made under or for the purposes of any Act; " metric system of measurement " means measurement in terms of metric units of measurement of physical quantity prescribed by regulations made under the Weights andMeasures(National Standards) Act1960-1966 of the Commonwealth, as amended from time to time, or under any Act of the Commonwealth in substitution for that Act; " metric units " means- (a) the units comprised in the International System of Units for the time being approved by the General Conference on Weights and Measures; (b) units decimally related to those units and for the time being so approved; (c) such other units as are declared from time to time pursuant to the Metric Conversion Act1970 of the Commonwealth, as amended from time to time, or pursuant to any Act of the Commonwealth in substitution for that Act, to be within the metric system. 4. Commonwealth instruments excluded from Act. This Act shall not apply in relation to any instrument having effect in the State made by or on behalf of the Crown in right of the Commonwealth or made under or for the purposes of an Act of the Commonwealth. PART 11-AMENDMENT OF REFERENCES TO MEASURE 5. Commencement of this Part. (1) The provisions of this Part shall come into operation in relation to each of the Acts specified in the First Schedule or in relation to each of the provisions (so specified) of those Acts on a date to be appointed in relation to that Act or, as the case may be, in relation to that enactment by Proclamation. (2) One Proclamation or several Proclamations may be made for the purposes of this section as the Governor thinks fit.

Metric Conversion Act 1972, No. 31 265 (3) A Proclamation made for the purposes of this section shall specify each of the Acts or, as the case may be, each of the enactments in relation to which this Part is thereby to come into operation and may so appoint a date for the commencement of this Part in relation to any Act or enactment therein specified that such date differs from a date appointed by the Proclamation in relation to any other Act or enactment therein specified. 6. Amendment of scheduled Acts. The Acts specified in the First Schedule are amended in the provisions and to the extent therein specified. 7. Collective title of amended Act. An Act as amended by this Act in respect of any provision thereof may be collectively cited as indicated in relation to that Act in the First Schedule. PART Ill-CONSTRUCTION OF REFERENCES TO MEASURE 8. Application of this Part. (1) The provisions of this Part shall apply only in relation to such Acts and instruments or to such provisions of Acts and instruments as are prescribed from time to time by Order in Council and shall so apply on and from the date of publication of the Order in Council in the Gazette or, if a later date is appointed by the Order in Council in relation to any Act, instrument or provision specified therein, shall so apply in relation to that Act, instrument or provision on and from the date so appointed. (2) An Order in Council made for the purposes of this section shall specify the Acts, instruments and provision in relation to which this Part is thereby to apply and may so appoint a date for the application of this Part in relation to any Act, instrument or provision therein specified that such date differs from a date appointed by the Order in Council in relation to any other Act, instrument or provision therein specified. (3) The provisions of this Part shall not apply in relation to any provision of an Act, which provision is specified in the First Schedule. 9. Application of this Part subject to express provisions. The application of the provisions of this Part in relation to any Act, instrument or provision of an Act or instrument is subject to the express provisions of that Act or instrument governing the construction of a reference therein to a measurement of physical quantity. 10. Construction of references to units of physical quantities. (1) Where in a provision of an Act or instrument to which the provisions of this Part apply reference is made to a measurement of a physical quantity in terms of a unit of measurement other than a unit of measurement of the metric system of measurement that reference may, where the case requires it, be read and construed as a reference to that physical quantity measured in terms of the appropriate unit or units of measurement of the metric system of measurement and expressed accordingly.

266 M etric Conversion Act 1972, No. 31 (2) In expressing a reference in accordance with subsection (1) use shall be made of such number of metric units as is required to most accurately express that reference and a decimal sub-multiple of the smallest ,such unit so required shall be expressed to a degree of accuracy of not more than three decimal places. 11. Construction of references to units not of physical quantities. Where in a provision of an Act or instrument to which the provisions of this Part apply reference to a unit of measurement specified in the first column of the Second Schedule is made otherwise than as a reference or part of a reference to a measurement of a physical quantity that reference may, where the case requires it, be read and construed as a reference to the unit of measurement specified in the second column of the schedule opposite to that first-mentioned unit of measurement and any form prescribed by any such Act or instrument that is completed in reliance on this section shall, to that extent, be taken to be sufficiently completed as prescribed by that Act or instrument. PART IV-MISCELLANEOUS PROVISIONS 12. Alteration of instruments of title to and . (1) Whenever an instrument of title to land or to any interest in land comes into the possession of the Registrar of Titles, the Registrar of Dealings, or other person charged by law with the function of recording dealings affecting the land in question (all such persons being, in this section, called " the registrar ") it is lawful for the registrar to alter all references therein to a unit of measurement other than a unit of measurement of the metric system of measurement to references to the appropriate unit or units of measurement of the metric system of measurement and where the registrar does so, he shall in like manner alter the copy of the instrument of title concerned that is held by him. (2) For the purpose of altering a reference pursuant to subsection (1) the registrar shall make use of such number of metric units as is required to most accurately express that reference and shall express a decimal sub-multiple of the smallest such unit so required to a degree of accuracy of not more than three decimal places. 13. Dealings with land may follow instrument of title . For as long as an instrument of title to land or to any interest in land shows units of measurement of that land as units of a system of measurement other than the metric system of measurement any document relating to that land or interest that refers to the units of measurement of the land in that other system, other than a plan of survey of the land or any part thereof, shall not be withheld from registration at any public registry of title to that land or interest by reason only of that reference. In the case of a plan of survey, the person in charge of the public registry concerned may exercise his discretion as to the acceptance of that plan having regard to the date of completion of the survey to which the plan relates. 14. Amendment of scheduled provisions not to affect contracts made. The corning into operation of Part II in relation to any enactment specified in the First Schedule shall not affect in any way a contract made, transaction entered into, or dealing effected before the date on and from which Part II comes into operation in relation to that enactment.

Metric Conversion Act 1972, No. 31 267 15. Amendment of licence , etc., that shows units of measurement. (1) Where there is issued for the purposes of any Act or instrument, either before or after the passing of this Act, a licence or permit that refers to physical quantities in terms of units of measurement other than units of the metric system of measurement and by reference to such physical quantities any liability of the holder of the licence or permit is to be assessed, the person or authority for the time being controlling the issue of such licences or permits- (a) may require the holder to surrender the licence or permit for the purpose of having another licence or permit issued in lieu; (b) whether or not the holder surrenders the same as required, may cancel the licence or permit and issue in lieu a licence or permit that refers to those physical quantities in terms of the appropriate unit or units of measurement of the metric system of measurement, and, if it is desirable so to do, may vary any monetary reference therein by which the holder's liability is to be assessed. (2) Where a licence or permit is issued in lieu of one cancelled pursuant to this section any liability of the holder of the licence or permit that is to he assessed by reference to physical quantities and monetary references expressed in the licence or permit shall thereafter be assessed by reference to the licence or permit issued in lieu instead of by reference to the licence or permit so cancelled. (3) The terms of a licence or permit shall not be so varied pursuant to this section as to increase the liability of its holder thereunder. 16. Conversion to metric units not to affect existing structures. Where there is prescribed by or under any Act a. maximum, minimum, or standard measurement by means of a reference to a unit of measurement other than a unit of measurement of the metric system of measurement (such maximum, minimum, or standard measurement being in this section called the " standard of dimension ") and that standard of dimension is material to any building or structure or any part thereof erected before that reference is, by legislation of any type, converted into terms of a unit of measurement of the metric system of measurement that standard of dimension shall not cease, by reason only of the conversion, to be the standard of dimension material to such portions of that building or structure or of the relevant part thereof as, after the conversion, remain unaltered in the na° ;cular to which the standard of dimension is material. 17. Conversion to metric units not to exclude erected material from prescribed class. Where there is prescribed by or under any Act a class or description by means of a reference to a unit of measurement other than a unit of measurement of the metric system of measurement, material that forms a, part of a building or structure and that is within that class or description immediately before that reference is, by legislation of any type, converted into terms of a unit of measurement of the metric system of measurement shall not be taken to have been excluded from that class or description by reason only of the conversion for as long as it continues to form that part of the building or structure.
