An Act to Confirm the Union in Queensland of the Wesleyan Methodist Church in Queensland and the Primitive Methodist Connexion in Queensland, under the name of "The Methodist Church of Australasia " ; to deal with the Property in Queensland of the said Uniting Churches, and to assimilate the Trusts thereof; to Amend "The Wesleyan Methodist Church Property Trust Act, 1893 " ; and for other purposes connected with or incidental to the aforesaid objects, 5 Edw. VII. THE METHODIST UNION ACT OP 1905. [ASSENTED TO 20TH DECEMBER, 1905.] HEREAS the General Conference of the Austral- Preamble. asian Wesleyan Methodist Church, held at Adelaide, in South Australia, in the year one thousand eight hundred and ninety-four, empowered and authorised each Annual Conference of the said Church to carry into

VII., effect within its own bounds union with any or all of the other Methodist Churches within its bounds on the consti- tutional basis defined by the said General Conference and set forth in the, printed minutes of such General Confer- ence of the year one thousand eight hundred and ninety- four, but subject to a provision that until Methodist Union had become general throughout Australasia the name of such Uniting Churches should, when united, be "The Australasian Wesleyan Methodist Church," and that there- after the United Church should be denominated "The Methodist Church of Australasia": And whereas there was established in Queensland a religious denomination, community, or church known as the Primitive Methodist Connexion forming part of the Connexion established in the United Kingdom of Great Britain and Ireland, and known as the Primitive Methodist Connexion: And whereas, by and with the authority and consent both of the Fifth Queensland Conference held. at Brisbane, in Queensland, in the year one thousand eight hundred and ninety-seven (being a Queensland Conference within the meaning of" The Wesleyan 3fethodist Church _Property Trust Act, 1893"),* and of the Annual Conference of the said Primitive Methodist Connexion in Queensland, held at Brisbane aforesaid in the year one thousand eight hundred and ninety-seven (being the governing body of the said Primitive Methodist Connexion in Queensland, and duly empowered to give such authority and consent, subject, however, to the approval of the general governing body of the said Connexion, namely, the British Conference of the said Connexion), an agreement was duly made between the Wesleyan Methodist Church in Queensland and the Primitive Methodist Connexion in Queensland, hereinafter called the " Uniting Churches," to enter into an organic union as one Church under the name of "The Australasian Wesleyan Methodist Church," as from the first day of January, one thousand eight hundred and ninety-eight, on the said constitutional basis and in terms of a plan of union agreed to, which said plan of union is fully set forth in the printed minutes of the Sixth Queensland Conference, held at Brisbane aforesaid in the year one thousand eight hundred and ninety-eight, it being agreed that when Methodist Union had become general throughout Aus- tralasia the United Church should be denominated "The Methodist Church of Australasia": * 57 Vic., supra, page 4900.

And whereas the Union of the said Primitive Methodist Connexion in Queensland with the said Wesleyan Methodist Church in Queensland, as from the said first day of January, one thousand eight hundred and ninety-eight, on the said constitutional basis and in terms of the said plan of union, was duly approved by the said British Conference of the said Primitive Methodist Con- nexion held at Grimsby, in the said United Kingdom, in the year one thousand eight hundred and ninety-nine, which said Conference, and each succeeding British Conference of the said Connexion, empowered its general committee to authorise and direct that all property, lands, buildings, hereditaments, and premises of every description and tenure of or belonging to, or used in connection with or for. the purposes of, or held upon trust for or on behalf of, and within the jurisdiction of, the said Primitive Methodist Con- nexion. in Queensland, and whether standing in the name of a corporation or in the names of individual trustees or otherwise, should be sold or be transferred to and vested in trustees for and on behalf of "The Methodist Church of Australasia" in Queensland in such manner and upon such trusts as the Queensland Annual Conference of the said Methodist Church should or might from time to time direct, authorise, or appoint, with full liberty to the said Queensland Annual Conference to secure the passing of such legislative enactments by the Parliament of Queens- land as might be considered necessary or advisable for the purpose of giving complete effect to the Union of the said Churches and to any resolutions of the said Queensland Annual Conference relating to or dealing with the pro- perties, land, buildings, hdreditaments, and premises held upon trust for or on behalf of the said Primitive Methodist Connexion in Queensland as aforesaid; and further empowered its said general committee to instruct the president and secretary for the time being of the British Conference of the said Primitive Methodist Connexion to sign all documents necessary for the purpose of giving full effect to and authenticating the exercise of the aforesaid powers of the said general committee: And whereas the said general committee, in pur- suance of the aforesaid powers, did by an instrument in writing, dated the fourteenth day of September, one thou- sand nine hundred and three, authorise and direct that the lands and premises mentioned and described in the First Schedule to this Act and all other the property, lands,, 8971

VII., buildings, hereditaments, and premises of every description and tenure of or belonging to, or used in connection with or for the purposes of, or held upon trust for or on behalf of, and within the jurisdiction of, the said Primitive Methodist Connexion in Queensland, and whether standing in the name of a corporation or in the names of individual trustees or otherwise, should be sold or be transferred to and vested in trustees for and on behalf of "The Methodist Church of Australasia" in Queensland in such manner and upon such trusts as the Queensland Annual Conference of the said Methodist Church should or might from time to time direct, authorise, or appoint, with full liberty to the said Queensland Annual Conference to secure the passing of such legislative enactments by the Parliament of Queens- land as might be considered necessary or advisable for the purpose of giving complete effect to the Union of the said Churches and to any resolutions of the said Queensland Annual Conference relating to or dealing with the pro- perties, lands, buildings, hereditanaents, and premises held upon trust for or on behalf of the said Primitive Metho- dist Connexion in Queensland as aforesaid; and, for the purpose of giving full effect to and authenticating the exercise of the aforesaid powers, did instruct Thomas Hankey Hunt, the president, and John Day Thompson, the secretary of the British Conference of the said Primi- tive Methodist Connexion, held at Newcastle-on-Tyne, in the said United Kingdom, in the year one thousand nine hundred and three, to sign the said instrument on behalf of the said. general committee: And whereas the said instrument was duly signed by the said Thomas Hankey Hunt and John Day Thompson, in pursuance of the aforesaid instructions of the said general committee, and also by Robert Bryant, the chair- man, and John Hallam, the secretary of the said general committee, on the said fourteenth day of September, one thousand nine hundred and three: And whereas pursuant to the agreement aforesaid the Uniting Churches did, on the first day of January, one thousand eight hundred and ninety-eight, enter into an organic Union as one Church, under the name of "The Australasian Methodist Church," on the said constitutional basis and in terms of the said plan of union: And whereas Methodist Union became general through- out Australasia on the first day of January, one thousand nine hundred and two:

And whereas the successive Queensland Annual Con- ferences of the Australasian Wesleyan Methodist Church held in the years one thousand eight hundred and ninety- eight, one thousand eight hundred and ninety-nine, one thousand nine hundred, and one thousand nine hundred and one, and of the Methodist Church of Australasia held in the years one thousand nine hundred and two, one thousand nine hundred and three, one thousand nine hundred and four, and one thousand nine hundred and five, have included ministerial and lay representatives of both the Uniting Churches, and have held, made, and passed certain elections, appointments, resolutions, and orders on the said constitutional basis and in pursuance of the said plan of union: And whereas the Church named in the said constitu- tional basis is throughout such basis called "The Australasian Methodist Church," and the Missionary Society named therein is called "The Australasian Methodist Missionary Society," and by reason of the fact that Methodist Union has become general throughout Australasia, it has become necessary to alter the denomina- tion of the said Church and Society: And whereas under " The Wesleyan Methodist Church Property Trust Act, 1893,"* all Church lands within Queensland of the Wesleyan Methodist Church are held upon the trusts and subject to the provisions of "The Wesleyan Methodist Model Deed of Queensland, 1892 " : And whereas the Church lands within Queensland of the Primitive Methodist Connexion are held on various trusts for the pu.rpoSes of the said denomination, and it is desirable, in order fully to consummate the Union and in order to attain uniformity in the trusts, that these Church lands and all other Church lands hereafter to be acquired within Queensland should be held on the trusts and subject to the provisions of the said Model Deed: And whereas the General Conference of the Austral- asian Wesleyan Methodist Church (now denominated the Methodist Church of Australasia) has duly empowered each Annual Conference of the said Church hhaavviinncg, jurisdiction within each State of the Commonwealth of to obtain such legislative enactments as may be necessary to give effect to such Union: And whereas legislative authority has been obtained by Acts of Parliament of the States of New South Wales, Victoria South Australia and Tasmania confirmina. the 57 Tics., siipitc, page 4900. 8973

Uniting Churches within those States respectively, and declaring the trusts upon which the real and personal property therein of the said Uniting Churches should thenceforth be held: And whereas it is necessary and desirable to obtain legislative authority to confirm the Union within Queens- land of the Uniting Churches, and to declare the trusts upon which all real and personal property in Queensland now held or hereafter to be held in trust for or in anywise belonging to the Uniting Churches—namely, the Wesleyan Methodist Church in Queensland and the Primitive Methodist Connexion in Queensland—shall henceforth be held, and to amend certain provisions of "The Wesleyan Methodist Church Property Trust Act, 1893,"* and to provide for other matters appertaining to the Uniting Churches: Be it therefore enacted by the King's Most Excellent . That Act and this Act may be cited together as " The Methodist Church Property Acts, 1893-1905." Interpreta- 2. In this Act, unless the context otherwise indicates, tion. the following terms have the meanings assigned to them respectively, that is to say :— "Constitutional basis"—The constitutional basis defined by the General Conference of the Australasian Wesleyan Methodist Church held at Adelaide, in South Australia, in the year one thousand eight hundred and ninety- four, as set forth in the printed minutes of such conference; "Model Deed "—" The Wesleyan Methodist Model Deed of Queensland, 1892," referred to in the Principal Act, and hereinafter referred to as "The Methodist Model Deed of Queensland," and any duly authorised alteration or modifica- tion thereof, and any revised Model Deed pre- pared and adopted in substitution therefor as provided by this Act; * 57 Vie., supra, page 4900.
CHURCHES AND CHAPELS. 89175 1905. Methodist Union Act. "Plan of union"—The plan of union of the Wes- leyan Methodist Church and of the Primitive Methodist Church agreed to by the Fifth Queensland. Conference of the Wesleyan Methodist Church held at Brisbane, in Queensland, in the year one thousand eight hundred and ninety-seven, and by the Annual Conference of the Primitive Methodist Church held at Brisbane aforesaid in the year one thousand eight hundred and ninety-seven (being the governing body of the Primitive Methodist Church), as set forth in the printed minutes of the Sixth Queensland Conference of the Wesleyan Methodist Church ; "Primitive Methodists"—The members of the religious community commonly known by that name. The term includes the people in Queensland on the thirty-first day of December, one thousand eight hundred and ninety-seven, connected in religious fellowship and church government, and called by that name and forming part of the Connexion established in the United KingdQm. of Great Britain and Ireland and known as the Primitive Methodist Connexion; "Primitive Methodist Church"— The Church, Connexion, Society, religious denomination, or community of the Primitive Methodists in Queensland; "Register of Trustees"—The Methodist Church Register of Trustees for Queensland; "Uniting Churches"—The Wesleyan Methodist Church and the Primitive Methodist Church; "Wesleyan Methodist Church"—The Australasian Wesleyan Methodist Church in Queensland. 3. (2.) The constitutional basis shall be read and con- strued as if the words "The Methodist Church of Aus- tralasia" were inserted in place of the words "The

VII., Australasian Methodist Church," wherever such words occur, and as if the words "The Methodist Missionary Society of Australasia" were inserted in place of the words "The Australasian Methodist Missionary Society," where- ever such words occur. (3.) The Methodist Church of Australasia shall, on and from the first day of January, one thousand eight hundred and ninety-eight, be deemed to have been and to be the Wesleyan Methodist Church within the meaning of and for all purposes under the provisions of the Principal Act. (4.) Every General Conference of the Methodist Church of Australasia held before the passing of this Act shall be deemed to have been a General Conference within the meaning of and for all purposes under the provisions of the Principal Act; and every such General Conference hereafter to be held shall be deemed to be a General Con- ference within the meaning of and for all purposes under "The Methodist Church Property Acts, 1893-1905." (5.) The Model Deed shall, after the passing of this Act, be known, referred to, and cited as "The Methodist Model Deed of Queensland." (6.) The Wesleyan Methodist Church Register of Trustees for Queensland, referred to in the Principal Act, shall, after the passing of this Act, be called and inscribed "The Methodist Church Register of Trustees for Queens- land." (7.) The Queensland Conference of the Methodist Church of Australasia and the president for the time being thereof shall have and possess, and are hereby invested with, the like powers to consent and to approve of all matters and things which, at the time of the passing of this Act, were had or possessed by the Queensland Confer- ence of the Australasian Wesleyan Methodist Church and the president thereof, respectively. (8.) Whenever any act, matter, or thing is required to be done, authenticated, testified to, or certified by the president or other like officer of the Conference of either of the -Uniting Churches, such act, matter, or thing may be done, authenticated, testified to, or certified by the president for the time being of the Queensland Conference of the Methodist Church or Australasia. Confirmation 5. Methodist Union Act. hundred, and one thousand nine hundred and one, which included ministerial and lay representatives of the Uniting Churches, and the Queensland Conferences of the Methodist Church of Australasia held at Brisbane in the years one thousand nine hundred and two, one thousand nine hundred and three, one thousand nine hundred and four, and one thousand nine hundred and five, which included ministerial and lay representatives of the Uniting Churches, and all elections, appointments, resolutions, and orders held, made, and passed by all such Conferences, and all dealings with the property, whether real or personal, of the Uniting Churches or either of them, had or commenced in pursu- ance of any resolution or order of any of such Conferences, are hereby confirmed and declared to be valid for all purposes, and all such dealings not completed at the passing of this Act may be continued and completed in conformity with such resolution or order. The said Queensland Conferences shall be deemed to have been Queensland Conferences within the meaning of and for all purposes under the Principal Act. Every Queensland Conference of the Methodist Church of Australasia hereafter to be held shall he deemed to be a Queensland Conference within the meaning of and for all purposes under " The Methodist Church Property Acts, 1893-1905." 6. (1.) And whereas doubts have arisen whether the Extension of term "Church lands" as defined by the Principal Act ecfl= of includes certain lands and premises held upon tenures lands." peculiar to goldfields and mineral fields, and it is desirable to set all such doubts at rest and to make better provision for the registration of the title to such lands and premises, it is hereby declared and enacted that for all purposes under " The Methodist Church Property Acts, 1893-1905," and notwithstanding anything contained in " The Mining Act or 1898 "* or any Act amending or in substitution for that Act, the term "Church lands" as defined by the Principal Act includes all lands, premises, claims, areas, leaseholds, tenements, and interests which are now held, possessed, or occupied, or which may at any time hereafter be acquired and . held, possessed, or occupied, under any right, lease, license, authority, or tenure peculiar to goldfields or mineral fields, upon or subject to any of the trusts upon which Church lands as defined by the Principal Act are held or may be acquired and held, and that all the provisions of "The Methodist Church Property Acts, 1893-1905," * 62 Vie. VII., accordingly apply to all such lands, premises, claims, areas, leaseholds, tenements, and interests now held, possessed, or occupied, or hereafter to be acquired and held, possessed, or ot•cupied as last aforesaid. Registration (2.) Moreover, in the case of Church lands held, olafnCdhsuurncdher possessed, or occupied, or hereafter to be acquired and held, mining possessed, or occupied as last aforesaid, the warden of the tenures. goldfield or mineral field in which the same are situated is hereby authorised and required, upon the production to him of an extract purporting to be an extract from the Register of Trustees relating to such lands in the form and certified in the manner prescribed by section ten of the Principal Act, to register the holders or lessees thereof for the time being, and to issue a certificate or certificates of registration in their names "As Trustees under the provisions of the Methodist Model Deed of Queensland." Trusts upon 7. (1.) All Church lands which, at the time of the wWheisclheyan passing of this Act, are held upon the trusts of the Model Methodist Deed, or are otherwise held on behalf of or in trust for the aCrheutrochbe hlaenldds. W esleyan Methodist Church, shall, from and after the passing of this Act, be held for the Methodist Church of Australasia upon the trusts stated in and subject to the provisions of the Model Deed, and subject to " The Methodist Church Properly Acts, 1893-1905, but without prejudice to any transfer, mortgage, charge, encumbrance, lien, lease, agreement, or other transaction affecting the same, and upon and subject to no former or other trusts or provisions whatsoever. Trusts upon (2.) The lands and premises mentioned and described wofhPircihmliatnivdse in the First Schedule to this Act, and all other lands and Methodist premises of whatever tenure (including all chattels real and tCohbuerchheladre `-'" lands, premises, claims, areas, leaseholds, tenements, and interests held, possessed, or occupied under any right, lease, license, authority, or tenure peculiar to goldfields or mineral fields), together with all rights, easements, and appurtenances, whether relating thereto or therewith usually held or enjoyed, which, at the time of the passing of this Act, are held upon or subject to any trusts for the Primitive Methodist Church or the Primitive Methodists, and whether standing in the name of a corporation or in the names of individual trustees or otherwise, shall, from and after the passing of this Act, without any other conveyance than this Act, be transferred to and become and be vested in the following persons, namely, Reverend Henry Youngman, Reverend William Powell, Reverend Isaac Castlehow, George Down, accountant,

And Eugene Chapple, contractor, all of Brisbane afore- said; and shall be held by such persons as trustees for the Methodist Church of Australasia upon the trusts stated in and subject to the provisions of the Model Deed, but without prejudice to any transfer, mortgage, charge, encumbrance, lien, lease, agreement, or other transaction affecting the same, and upon and subject to no former or other trusts or provisions whatsoever; and all such lands and premises shall, for all purposes, be and be deemed to be Church lands; and all the provisions of" The Methodist Church Property Acts, 1893-7.905," and of the Model Deed shall accordingly apply to all such lands and premises and to the above-mentioned persons as the trustees thereof: Provided that nothing in this Act contained shall impose upon the above-mentioned persons, or any of them., or any of their successors in interest, any personal liability or responsibility, whether by way of indemnity or other- wise, for or in respect of any transfer, mortgage, charge, encumbrance, lien, lease, agreement, or obligation created or contracted in respect of any of the aforesaid lands or premises. 8. When by any will, deed, or other document, Devises, executed prior to the passing of this Act, any property bequests, &e. has been or shall be devised, bequeathed, given, granted, released, conveyed, or appointed to, or has been or shall be declared or directed to be held, upon trust for the benefit of, the Wesleyan Methodist Church or the Primitive Methodist Church, or intended so to be, or to or for the benefit of any church, chapel, school, fund, institution, society, or auxiliary in connection with either of the said Churches, or intended so to be, or is or shall be or become receivable by or payable to any such church, chapel, school, fund, institution, society, or auxiliary, or receivable by or payable to any officer thereof, and when by any will, deed, or other document, executed prior to the passing of this Act, any power, authority, discretion, or power to consent is given to or becomes exer- cisable by or is required from the Wesleyan Methodist Church or the Primitive Methodist Church, or any con- ference, district committee, district meeting, or district synod of either of the said Churches, or the president, chairman, secretary, or other officer, or any minister thereof in his official capacity, every such will, deed, or other document, and every devise, bequest, legacy, testa- mentary disposition, gift, grant, conveyance, transfer,

VII.,. assignment, appointment, declaration of trust, power, authority, discretion, and consent therein contained or referred to, or intended so to be, shall be read and con- strued and operate and take effect as if— (a) The Methodist Church of Australasia had been named or referred to therein in place of the Uniting Church named or referred to, or intended so to be; (b) The Queensland Conference of the Methodist Church of Australasia had been named or referred to therein in place of the Conference of the Uniting Church named or referred to„ or intended so to be; (c) The district meeting, or district synod, or corres- ponding church court or committee of the Methodist Church of Australasia had been named or referred to therein in place of the district committee, district meeting, or district synod named or referred to, or intended so to be; (d) The president or secretary of the Queensland Conference of the Methodist Church of Aus- tralasia had been named or referred to in place of the president or secretary named or referred to, or intended so to be; and (e) The chairman, minister, officer, church, chapel, school, fund, institution, society, or auxiliary of the Uniting Church named or referred to, or intended so to be, had been named or referred to as a chairman, minister, officer, church, • chapel, school, fund, institution, society, or auxiliary of the Methodist Church of Aus- tralasia. The signature of the president for the time being of the Queensland Conference, signifying the exercise of such power, authority, or discretion, or the giving of such consent, shall be evidence of the exercise of such power, authority, or discretion, and of the giving of such consent, respectively. The receipt in writing of the said president, or of any person or persons duly appointed by him from time to time in. that behalf, shall be a sufficient discharge to the person or persons liable to pay, deliver, or transfer any money or personal property under such will, deed, or other document. All property, real and personal, so devised, bequeathed, given, granted, released, conveyed, or appointed, or declared or directed to be held upon trust, shall, subject to " The Methodist Church _Property Acts, 1893-1905," and to the

(2.) A revised Model Deed, showing all alterations and modifications authorised up to the date of such revision, may from time to time be prepared and adopted by the Queensland Conference, and shall, after being certified under the hand of the president of the said Conference, and lodged and enrolled in the office of such Registrar of Titles, be intituled "The Methodist Model Deed of Queensland," and shall thereafter be the Model Deed for all purposes under "The Methodist Church Property Acts, 1893-1905," in lieu of the Model Deed superseded thereby.
