Queensland Subordinate Legislation 1991 No. 34 METALLIFEROUS MINING (AMENDMENT) REGULATIONS 1991 Department of Resource Industries Brisbane, 25th July, 1991 HIS Excellency the Administrator of the Government, acting by and with the advice of the Executive Council and in pursuance of the provisions of the MinesRegulationAct1964-1989 , has been pleased to make the following regulations. KEN VAUGHAN Minister for Resource Industries METALLIFEROUS MINING (AMENDMENT) REGULATIONS 1991 Short title 1. These regulations may be cited as the Metalliferous Mining (Amendment) Regulations 1991 . Principal regulations 2. The Metalliferous Mining Regulations 1985 as subsequently amended are referred to in these regulations as the Principal Regulations.
2 Metalliferous Mining (Amendment) Regulations No. 34, 1991 New reg 4.36 ISOLATION PROCEDURES 3. The Principal Regulations are amended by inserting after regulation 4.35 the following regulation— ‘4.36 ISOLATION PROCEDURES 4.36.(1) The manager must establish an isolation procedure to prevent any person who performs work on equipment, plant or machinery in, on or about a mine from coming into contact with an energy source that is likely to cause injury. (2) A person who carries out the isolation procedure must conform to the procedure established by the manager. (3) For the purposes of subregulation 4.36(1), the provisions of subregulation 11.3(8) or 11.3(9), as the case may be, apply with respect to the carrying out of the electrical isolation procedure. (4) The isolation procedure is to be in writing and except as directed or allowed otherwise, is to include a requirement that the person carrying out the isolation procedure ensures— (a) that the energy source is isolated by means of an isolation device locked in the position that isolates the energy; and (b) that a duly completed personal danger tag is attached to the isolation device. (5) The person who carried out the isolation procedure must— (a) on completion of the procedure, ensure that the equipment, plant or machinery is tested to establish that the isolation is effective; and (b) ensure that the work place is safe, before removing the personal danger tag and unlocking the isolation device to restore the energy source. (6) A person, other than the person who carried out the isolation procedure, must not remove the personal danger tag or unlock the isolation device: Provided that where the person who carried out the isolation procedure is not then present, a person authorised in writing by the manager must first ensure that the work place is safe before removing the personal danger tag and unlocking the isolation device to restore the energy source. (7) For the purposes of this regulation, the term “personal danger tag” means a notice in accordance with the Australian Standard 1319-1983
3 Metalliferous Mining (Amendment) Regulations No. 34, 1991 Safety Signs for the Occupational Environment containing— (a) the words ‘DANGER DO NOT OPERATE’; (b) the date and time of attachment; (c) the full name and signature of the person attaching the tag; (d) the reasons for attachment of the tag; and (e) a warning that the tag must be removed only by the person who attached it or a person authorised by the manager. ’. New reg. 4.37 OUT OF SERVICE PROCEDURES 4. The Principal Regulations are amended by inserting after regulation 4.36 the following regulation— ‘4.37 OUT OF SERVICE PROCEDURES 4.37(1) The manager must establish an out of service procedure so that equipment, plant or machinery in, on or about a mine, that is found to be unsafe or unserviceable or is likely in the opinion of the manager to become unsafe or unserviceable, is not used. (2) The out of service procedure is to be in writing and, except as directed or allowed otherwise, is to require the person who is responsible for using, operating, controlling, or examining the equipment, plant or machinery in, on or about a mine to warn all other persons of its condition by placing a duly completed out of service tag at the control device of the equipment, plant or machinery. (3) A person, other than the person who is responsible for the repair of the defects which render the equipment, plant or machinery unsafe or unserviceable, must not remove an out of service tag or use the equipment, plant or machinery to which a tag is attached: Provided that where the person who is responsible for the repair is not then present, a person authorised in writing by the manager must first take precautions to ensure that no person will become endangered by the use of the equipment, plant or machinery before removing the tag. (4) An out of service tag must not at any time be used in place of a personal danger tag. (5) For the purposes of this regulation, the term “out of service tag”
4 Metalliferous Mining (Amendment) Regulations No. 34, 1991 means a notice in accordance with Australian Standard 1319-1983 Safety Signs for the Occupational Environment containing— (a) the words ‘CAUTION OUT OF SERVICE’ and the words ‘DO NOT USE OR OPERATE’; (b) the date and time of attachment; (c) the full name and signature of the person attaching the tag; (d) the reason for attachment of the tag; (e) a warning that the tag must be removed only by the person who is responsible for the repair of the equipment, plant or machinery or a person authorised by the manager; and (f) a warning that the out of service tag must be used only for the protection of equipment, plant or machinery. ’. Amendment of reg. 7.4 EQUIPMENT OF VEHICLE 5. Regulation 7.4 of the Principal Regulations is amended by— (a) in paragraph (f) of subregulation 7.4(1), omitting the word ‘ and ’ where it last occurs; (b) in paragraph (g) of subregulation 7.4(1), omitting the expression ‘ . ’ where it occurs and substituting the expression ‘ ; ’ ; (c) in subregulation 7.4(1), inserting after paragraph (g), the following paragraph— ‘ and (h) shall be provided with seat safety belts. ’; (d) renumbering the existing subregulation 7.4(2) as 7.4(3); (e) inserting after subregulation 7.4(1), the following subregulation— ‘(2) A person travelling within a vehicle must at all times use the seat safety belts that are provided in the vehicle. ’. Amendment of reg. 7.34 PRESSURE PIPEWORK 6. Regulation 7.34 of the Principal Regulations is amended by—
5 Metalliferous Mining (Amendment) Regulations No. 34, 1991 (a) omitting the expression ‘.’ where it last occurs and substituting the expression ‘:’; (b) inserting after the word ‘Applications:’ the following paragraph— ‘ Provided that these standards need not apply to pipework, valves and fittings where the working pressure does not exceed 1 000 kilopascals and where the design, material selection, installation and testing of the pipework, valves and fittings are supervised by an engineer who has a knowledge of pipework design. ’. Amendment of reg. 13.8 FIRST CLASS OR SECOND CLASS MINE MANAGER’S CERTIFICATE OF COMPETENCY 7. Regulation 13.8 of the Principal Regulations is amended by omitting the words ‘ othereducationalqualification ’ in paragraph (b) and substituting the words ‘ any other qualification ’ . ENDNOTES 1.
