hund red and seventy-nine t he land specified in t he First Schedule

hereto was g ran ted u n t o t he said E i g h t Reverend J a m e s M u r r a y the

Reverend P a t r i c k P u r c e l l R y a n and Charles Joseph Gal lagher the i r
heirs a n d assigns upon t ru s t for t h e erection thereon of a Roman
h u n d r e d and seventy-nine t h e land specified in t h e Second Schedule
here to was granted un to t h e E i g h t Reve rend J a m e s M u r r a y the

Reve rend Pa t r i ck Purce l l R y a n and Charles Joseph Gal lagher the i r heirs and assigns upon t r u s t for the appropr ia t ion thereof as t he site of a dwell ing-house ga rden and other appur tenances for t he c l e rgyman duly appointed to officiate in t he R o m a n Catholic C h u r c h Mer r iwa A n d whereas i t has been found t h a t t h e said sites for a C h u r c h and presbytery are unsu i tab le for t he purposes for which t hey were res­ pect ively g ran ted and it is expedient t h a t t he said land should bo sold and t h a t t h e proceeds to arise from such sale should be applied in or towards t he purchase of ano ther piece of land in t h e said vil lage of Mer r iwa in a more sui table position as a site for a R o m a n Catholic Church and Presby te ry and t h e erection of such church and presbytery thereon and for o ther purposes hereinaf ter ment ioned Be i t therefore enacted by the Queen ' s Most Exce l l en t Majes ty by and wi th t he advice and consent of t h e Legis la t ive Council and Legis la t ive Assembly

of N e w South Wales in P a r l i a m e n t assembled and by the au thor i ty of
t he same as follows :—

1. Af ter t he passing of this Ac t i t shall be lawful for t he said J a m e s M u r r a y P a t r i c k Pu rce l l R y a n and Charles Joseph Gal lagher (hereinafter styled Trustees) the i r heirs or assigns or o ther t he Trustees for the t ime being of t he said g ran t s bear ing date respectively t he four th December in t h e year of our Lord one thousand e ight hund red and seventy-nine to sell and dispose of t h e said land specified in t he Schedules here to b y publ ic auc t ion or pr ivate cont rac t and ei ther in one lot or in several lots as t hey shall deem mos t expedient for such pr ice or prices as can be had or obtained for t h e same and w h e n sold to convey the same or any pa r t or par t s thereof to t he purchaser or purchasers in fee s imple freed and discharged from t h e said t rus t s affecting t he same and t h e receipt in wr i t ing of the said Trustees t h e i r heirs or assigns shal l absolutely discharge t he purchaser or purchasers of t h e said land or any p a r t or par t s thereof from t h e purchase money payable by h i m or t h e m respectively and shall exonera te h i m or t h e m from seeing to t he appl icat ion of t h e said purchase money and f rom all

l iabil i ty as to t h e misappl icat ion or nonappl icat ion thereof.

2. The said Trustees the i r heirs or assigns shall s tand possessed of all moneys arising from any and every such sale or sales as aforesaid u p o n t ru s t to app ly t he proceeds of such sale in or toward the p u r c h a s e of ano ther piece or pieces of land in t he said vil lage of M e r r i w a as a site or sites for t h e erection of a R o m a n Cathol ic Church and P r e s b y ­ te ry the reon and to app ly t h e r emainder of t he said moneys if any which

erect ion of a R o m a n Catholic Church and Presby te ry upon t h e land shall no t be requi red for t he purposes aforesaid in or towards t h e

to be purchased as aforesaid and the receipts of any person or persons to w h o m a n y moneys shall be paid unde r t he provisions of th i s A c t

shal l be valid and complete discharges to t h e Trustees the i r he i r s and
assigns for such moneys .
