Merit Protection (Australian Federal Police) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Merit Protection (Australian Government Employees) Act 1984.

1.   Amendment

1.1   The Merit Protection (Australian Federal Police) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Schedule (Modifications of the Merit Protection (Australian Government Employees) Act 1984)

2.1   Modification of subsection 3 (1):

Paragraph (b) of the definition of “Appeal Committee”:

Omit “Redeployment and”.

2.2   Substituted section 4:

Paragraph 4 (b):

Omit “redeployment and”.

2.3   Substituted section 4:

Paragraph 4 (c):

Omit the paragraph, substitute:

  • “(c)

    the review of:

    • (i)

      non-appellable promotions under section 36b of the Federal Police Act; and

    • (ii)

      decisions the review of which is authorised under subsection 36c (2), (3), (4) or (5) of the Federal Police Act;”.

2.4   Substituted paragraph 6 (b):

Omit the paragraph, substitute:

  • “(b)

    to review:

    • (i)

      non-appellable promotions under section 36b of the Federal Police Act; and

    • (ii)

      decisions the review of which is authorised under subsection 36c (2), (3), (4) or (5) of the Federal Police Act;

 in accordance with Division 3; and”.

2.5   Substituted paragraph 9 (a):

After “18c”, insert “, 25ca, 25cb”

2.6   Substituted section 11:

Omit “Division 2 of Part IIa of the Australian Federal Police Regulations as in force on 1 January 1989”, substitute “Part 2a of the Australian Federal Police Regulations”.

2.7   After the omission of Subdivision C of Division 2 of Part II, insert:

“Section 22:

 Omit ‘Redeployment and’.”.

2.8   Before the modification of subsection 23 (1), insert:

“Section 23:

 Omit ‘Redeployment and’.”.

2.9   Substituted section 24:

Omit “Division 2 of Part IIa”, substitute “Part 2a”.

2.10   After substituted section 24, insert:

“Subsection 25 (1):

 Omit ‘Redeployment and’.”.

“Section 26:

 Omit ‘Redeployment and’.”.

2.11   Substituted section 38:

Omit the substituted section, substitute:

Interpretation

“38.

In this Division, ‘decision’ means a decision:

  • (a)

    to promote a member of the Australian Federal Police where the promotion is a non-appellable promotion within the meaning of section 36b of the Federal Police Act; or

  • (b)

    the review of which is authorised under subsection 36c (2), (3), (4) or (5) of the Federal Police Act.”.

2.12   Substituted subsection 57 (2):

Paragraph (a) of the definition of “relevant decision”:

Omit the paragraph, substitute:

  • “(a)

    in respect of:

    • (i)

      a non-appellable promotion within the meaning of section 36b of the Federal Police Act; or

    • (ii)

      a decision the review of which is authorised under subsection 36c (2), (3), (4) or (5) of the Federal Police Act; or”.

2.13   Substituted subsection 57 (2):

Paragraph (b) of the definition of “relevant decision”:

Omit “, section 38c or subsection 38d (1) or 38e (1)”.

2.14   Substituted subsection 57 (2):

Paragraph (c) of the definition of “relevant decision”:

Omit “or 1b”, substitute “, 1b or 2a”.
