Act No. 80, 1985.
An Act to amend the Mental Health Act, 1983, with respect to the
investment of money standing to the credit of patients' accounts inhospitals mentioned in the Fifth Schedule to the Public Hospitals Act,
1929. [Assented to, 27th May, 1985.] Mental Health (Patients' Accounts) Amendment 1985
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—
Short title.
1. This Act may be cited as the "Mental Health (Patients' Accounts)
Amendment Act, 1985".
Amendment of Act No. 178, 1983.
The Mental Health Act, 1983, is amended in the manner set forth in
Schedule 1.
SCHEDULE 1.
(Sec. 2.)
AMENDMENTS TO THE MENTAL HEALTH ACT, 1983.
(1) Section 144 (1)—
Omit "and separate", insert instead " which are hospitals mentioned in the Fifth Schedule to that Act or which are separate".
(2) Section 144 (4)—
After section 144 (3), insert:—
(4) In this section—
(a) the reference to hospitals mentioned in the Fifth Schedule to
the Public Hospitals Act, 1929, includes a reference to any such hospital which is not a hospital within the meaning of this Act;
(b)
a reference to a patient's account, in relation to any such hospital which is not a hospital within the meaning of this Act, is a reference to a separate account in relation to a patient of that hospital into which money is paid that is received by the Secretary from the patient for custody on behalf of the patient or from some other person for the benefit, use or enjoyment of the patient; and

(c)
a reference to the Interest Account, in relation to any such hospital which is not a hospital within the meaning of this Act, is a reference to an account established and maintained by the Secretary for the purposes of this section in relation to that hospital.
