s1 2 s5 Mental Health Amendment (No. 2) No. 240, 1994 ˙ Short title 1. This regulation may be cited as the Mental Health Amendment Regulation (No. 2) 1994 . ˙ Commencement 2. This regulation commences on 1 July 1994. ˙ Regulation amended 3. This regulation amends the Mental Health Regulation 1985 . ˙ Insertion of new s 32A 4. Part 6, after section 32— insert— ˙ ‘ Patient review tribunal regions ‘ 32A.(1) For the purposes of section 14 of the Act (Patient Review Tribunals), the State is divided into the regions mentioned in column 1 of Schedule 6 (Patient review tribunal regions). ‘ (2) The area of each region mentioned in column 1 of the Schedule is the same as the area of the health service regions established under the HealthServicesAct1991 and mentioned in column 2 of the Schedule opposite its name.’. ˙ Insertion of new s 70 5. After section 69— insert— ˙ ‘ Transitional—applications or references to patient review tribunals ‘ 70.(1) This section applies if— (a) before the commencement of this regulation, an application or reference has been made by or for a patient under the Act to a patient review tribunal for a region (the “old tribunal” ); and
s6 3 s6 Mental Health Amendment (No. 2) No. 240, 1994 (b) the application or reference, if made after the commencement of this regulation, would be made to another patient review tribunal (the “new tribunal” ). ‘ (2) The application or reference is taken to have been made to the new tribunal. ‘ (3) An order, determination, finding, report or recommendation of the old tribunal about the application or reference is taken to have been made by the new tribunal. ‘ (4) The old and new tribunals must do all acts and things necessary or desirable to facilitate the division of the State under section 32A (Patient review tribunal regions) including, for example, the transfer of the records necessary to enable them to exercise their powers and performs their functions under the Act. ‘ (5) This section expires at the end of the day it commences.’. ˙ Insertion of new Sch 6 6. After Schedule 5— insert— ‘SCHEDULE 6 ‘PATIENT REVIEW TRIBUNAL REGIONS Tribunal Region Northern Central South Western Health Service Region • Peninsula and Torres Strait • Northern • Mackay • Central • Central West • Wide Bay • Darling Downs • South West
