s1 2 s4 Mental Health Amendment (No. 1) No. 297, 1995 ˙ Short title 1. This regulation may be cited as the Mental Health Amendment Regulation (No. 1) 1995 . ˙ Commencement 2. This regulation commences on 4 December 1995. ˙ Regulation amended 3. This regulation amends the Mental Health Regulation 1985 . ˙ Amendment of s 63 (Maintenance charges for treatment and control of a patient in a psychiatric hospital, security patients’ hospital or other place) 4.(1) Section 63(2), ‘Director’— omit, insert ‘medical superintendent’. (2) Section 63(3)(a), ‘30’— omit, insert ‘35’. (3) Section 63(3)(b)— omit, insert— ‘(b) for a patient in relation to whom a maintenance charge is payable under subsection (1)—for the last 30 days before discharge.’. (4) Section 63(4)— insert ‘(e) who has been issued with an acute care certificate.’. (5) Section 63— insert (6) A maintenance charge payable under subsection (1) or (2) may be
s4 3 s4 Mental Health Amendment (No. 1) No. 297, 1995 waived in whole if the director is satisfied the patient has not been issued with an acute care certificate but requires acute care. (7) In this section— “acute care certificate” means a certificate, in an approved form, issued by a doctor treating a patient in an acute care unit, stating the patient is in need of acute care for the period stated in the certificate. “acute care unit” means— (a) a psychiatric or security patients’ hospital, or a ward of a psychiatric or security patients’ hospital, that the director declares may be used for patients requiring acute care; or (b) a place, or part of a place, established under section 16 of the Act, that the director declares may be used for patients requiring acute care.’.
